Don Whittemore practices in the area of corporate, business and finance as well as commercial and real estate litigation. His practice consists of a broad range of commercial, business, and real estate matters, including both transactions and litigation. His representative clients have ranged from regional and national lending institutions, publicly-held companies, title companies, hotel owners, builders, to small and medium-sized privately held businesses.
Mr. Whittemore has represented business clients in virtually all aspects of business operations, from the initial formation of business entities to acquisitions and sales through asset purchase and stock sale transactions. He also has experience in negotiating, drafting and counseling business clients on a wide variety of business contracts, including shareholder and buy-sell agreements, limited liability operating agreements, patent license agreements, distributorship and sales representative agreements, and employment and non-competition agreements. His real estate transactional experience includes representing buyers and sellers of commercial real property, real estate leasing, and real property financing.
His experience representing financial institutions includes lending transactions secured by Florida and multi-state real estate, loan workouts and restructuring. Mr. Whittemore also has extensive experience representing lenders in foreclosure, loan collection and forbearance, and related special asset work, including creditor enforcement in bankruptcy proceedings.
He also has broad experience in representing clients in a variety of commercial and real estate litigation matters. He has represented clients in corporate shareholder disputes, commercial contract disputes, trademark infringement suits, construction disputes, construction lien foreclosures, commercial loan and mortgage foreclosures, bankruptcy, quiet title actions, title defect claims, receiverships, and commercial landlord/tenant matters. He has acted as trial counsel in cases in both federal and state court, in arbitration proceedings before the American Arbitration Association, and has argued appeals before the Florida Second and Fifth District Courts of Appeal, the Eleventh Circuit Court of Appeals, and the Fourth Circuit Court of Appeals.
Mr. Whittemore serves as the practice coordinator of the firm's business group in the Tampa office.
