She continued her education at the University of Miami School of Law where she obtained her Juris Doctorate degree. As a student, Ms. Gerber was extremely involved in both academic organizations and community outreach programs allowing her a unique perspective to the human element. I handle all types of spousal support claims whether it be for: temporary, durational, permanent, bridge the gap or rehabilitative alimony. Oftentimes, clients fail to understand that the main threshhold to securing an award of alimony is need of the payor vs. ability of the payee. This can include many challenges such as proving the true income or earning capacity of either party. My firm also handles the modification and enforcement of previously established alimony awards.
Family law includes: pre-nuptial agreements, post-nuptial agreements, divorce, child support, alimony, timesharing and parental responsibility, paternity, modification, enforcement and any other ancillary issue that one faces when family needs require legal attention. I pride myself on providing my clients with the accessibility and dedication they so deserve during the seemingly overwhelming time that often comes with being confronted with family law issues.
The umbrella of divorce encompasses many types of cases from simplified (where the parties have no children and no property together) to extremely complex. It is the main goal of my practice to educate clients on the law and ensure that their expectations are reasonable so as not to waste precious time and resources.
While child support must be in accordance with FL guidelines, there are many caveats to this including possible deviations from said guidelines. Moreover, it is extremely important that the true earning capacity of each spouse is ascertained which can prove to be difficult in the case of a self-employed party or one who is under-employed. I ensure that my clients are afforded every option for achieving this goal in either securing or defending against an unreasonable support claim.
Although the term custody is no longer utilized in FL, formulating a model of parental responsibility that works for all of the parties can be challenging. It is important to understand the factors that the ct. will consider when asked to approve a parenting plan/time-sharing schedule. Kids should not be used as pawns in these proceedings and that the parties will have to be co-parents for the next x-number of years so it is imperative they love their child more than they may dislike each other.
