The issues for consideration in this case are those promoted by an amended notice of proposed dismissal brought by Petitioner against the Respondent. If proven, this could bring about Respondent's removal from her position as a tenured teacher in the Duval County School System. See Chapter 21197, Laws of Florida, as amended by Chapters 72-576 and 81-372, Laws of Florida, also referred to as the Duval County Teacher Tenure Act (Tenure Act). In particular, Charge One alleges professional incompetence within the meaning of Section 4(e) of the Tenure Act associated with her performance in the school years 1987-88 and 1988-89 related to her duties affiliated with the "Jack Gordon Writing Skills Act of 1982", Section 236.1223, Florida Statutes. Respondent is also accused through Charge Two of refusing or inexcusably failing to discharge her duties associated with the maintenance of the student writing folders in the Jack Gordon Program. This latter charge corresponds to Section 4(c) of the Tenure Act.Teacher dismissed for failure to discharge duties and professional incompetence.
