Whether Respondent engaged in sexual misconduct in the practice of a healthcare profession, as defined in section 456.063(1), Florida Statutes (2019), and/or Florida Administrative Code Rule 64B8-9.008 (2019), with T.B. on or about February 25, 2020; and, if so, what discipline should be imposed.Respondent, a physician, did not engage in sexual misconduct as defined and prohibited by F.S. 456.063 because the alleged victim was not a patient at the time of the sexual assault.
