I firmly believe that the practice of law is a helping profession whose major goals should be the avoidance or equitable resolution of conflict, while protecting the rights of the client, helping the client to reach the client’s business goal and vigorously protecting and enforcing the client’s legal rights.
The first step in achieving this result is listening, really listening to the client and realizing that the needs of the client supersede the needs of the attorney. Most of my business clients understand their businesses better than I will ever understand their business. If the client is engaged in an area of business that they are not familiar with, the lawyer should never substitute the lawyer’s judgment for the client’s judgment, instead the lawyer should try to help the client find the expertise that they need to deal with an unfamiliar business situation. I have found this particularly to be the case when a client suffers a business reversal. I have done work with distressed companies for over 40 years, but I have found that helping a client to find a turnaround professional is more helpful to meet the client’s needs.
