Should Respondent, Department of Environmental Regulation (DER), grant the Applicant/Respondent Joseph Telese (Telese), a dredge and fill permit pursuant to the Notice of Intent to Issue filed August 21, 1990, in File No. 521715273. Are the jurisdictional lines setting forth the geographical area over which DER has permitting authority properly depicted in the Notice of Intent to Issue? Will the proposed project have adverse, cumulative impacts on the drainage flow in the area, as well as other natural resources in the locale? Will more fill be needed to complete the designed project than is represented in the permit application and Notice of Intent to Issue?Proposed development request to fill O.12 acres of tidal wetlands sufficiently offset negative impacts with mitigation.
