DOES THE 1976 AMENDMENT TO THE SOCIAL SECURITY ACT SET OUT AT
42 U.S.C.A. 405 (C)(2)(C)(I) AND (III) AMEND 7 OF THE FEDERAL PRIVACY ACT OF 1974, SO AS TO REQUIRE THE DISCLOSURE OF SOCIAL SECURITY NUMBERS FOR THE PURPOSES ENUMERATED IN 74 Ohio St. 3112?

SECTION 7(A) OF THE PRIVACY ACT OF 1974 STATES,
"IT SHALL BE UNLAWFUL FOR ANY FEDERAL, STATE, OR LOCAL GOVERNMENT AGENCY TO DENY TO ANY INDIVIDUAL ANY RIGHT, BENEFIT, OR PRIVILEGE PROVIDED BY LAW BECAUSE OF SUCH INDIVIDUAL'S REFUSAL TO DISCLOSE HIS SOCIAL SECURITY ACCOUNT NUMBER."
HOWEVER, THE SOCIAL SECURITY ACT,
THE CASE LAW WHICH EXISTS ON THIS TOPIC, ALTHOUGH SPARSE, DOES SUPPORT THE INTERPRETATION THAT THE SOCIAL SECURITY ACT AUTHORIZES MANDATORY DISCLOSURE WHERE TAX, GENERAL PUBLIC ASSISTANCE, DRIVER'S LICENSE ADMINISTRATION, OR VEHICLE REGISTRATION LAWS ARE CONCERNED. IN DOYLE V. WILSON, 529 F.SUPP 1343 (D. DEL. 1982), THE COURT EXPRESSLY STATED THAT SUBSECTION (D) OF THE PRIVACY ACT PROVIDES AN EXCEPTION TO THE ACT'S PROTECTION AGAINST DISCLOSURE OF SOCIAL SECURITY NUMBERS. SEVERAL COURTS HAVE UPHELD AS CONSISTENT WITH THE PRIVACY ACT LAWS AND REGULATIONS REQUIRING THAT SOCIAL SECURITY NUMBERS BE PROVIDED DURING APPLICATION FOR GENERAL PUBLIC ASSISTANCE. LIKEWISE, MANDATORY SOCIAL SECURITY NUMBER DISCLOSURE IS NOT UNCONSTITUTIONAL.
