RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by its duly designated Hearing Examiner, K. N. Ayers, held a public hearing on the above matter February 20, 1975, Miami, Florida.

There were no protestants.


  1. By these applications the City of Miami Beach seeks authorization for the rebuilding of the bridges over Normandy Waterway at Bay Drive and at Biarritz Drive and the installation of a 16" water main across Normandy Waterway at Rue Notre Dame. Although two separate applications are involved, they are interrelated and will be consolidated in one recommended order.


  2. The two bridges involved were erected in the 1930's on wooden piles and are in such a state of deterioration that further repair is impracticable and replacement is the only logical alternative. Water mains cross the waterway at each of these bridges and during replacement of each bridge the water main will be removed. In order to insure an adequate water supply to Normandy Isle during the period either of the existing water lines are interrupted during bridge construction it is proposed to install a 16" water main at Rue Notre Dame.


  3. The dredged material from' the trench to take the water main will be placed on land and reused for backfill after the main has been laid. The two bridges will be replaced with the minimum practicable disturbance to the waters of Biscayne Bay.


  4. In the absence of opposition the evidence need not be further delineated except to say the proposed projects are required in the public interest and will be constructed and operated in compliance with the Biscayne Bay Aquatic Preserve Act, 74-171, Laws of Florida. It is therefore,


RECOMMENDED that the applications of the City of Miami Beach be approved so as to authorize the replacement of bridges over the Normandy Waterway at Biarritz Drive and Bay Drive and the installation of an 16 inch water main over the Normandy Waterway at Rue Notre Dame all in accordance with the applications as filled.
