RECOMMENDED ORDER


After notice to the parties, a formal administrative hearing, pursuant to the Florida Administrative Procedures Act, was held in the County Commissioners Meeting Room, Bay County Courthouse Annex, Panama City, Florida, on May 9, 1975, before Delphene Strickland, Hearing Examiner.

ISSUES


Whether Respondent had violated Section 479.07(1), Florida Statutes, in that no permit was secured for subject sign for the year 1975.


FINDINGS OF FACT


No Permit was applied for or secured.


CONCLUSIONS OF LAW


Respondent is subject to the penalties of Section 479.17 and Section 479.10, Florida Statutes, inasmuch as the failure to secure permit is for the year 1975.

RECOMMENDED ORDER


Remove subject sign within (5) five days from date of Final Order unless Respondent either removes said sign and makes application and thereafter secures said permit.
