RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K. N. Ayers, held a public hearing on the above matter on June 17, 1975 in Ft. Lauderdale, Florida.


APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee, Florida for the Board of Cosmetology.


By this complaint the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Betty J. Hauser, the owner of the Golden Touch Hair Stylists on the grounds that on March 18, 1975 she did allow Molly J. Keene and James T. Fuller to practice cosmetology in her salon without the supervision of a master cosmetologist in violation of Section 477.02(4), Florida Statutes. Exhibit 1, receipt for Notice of Hearing sent by Certified Mail, was received into evidence.


On an Election of Remedies form subscribed and sworn to on June 13, 1975 Betty J. Hauser entered a plea of No Contest. On March 18, 1975 the inspector for the State Board of Cosmetology visited the Golden Touch Hair Salon on a routine inspection. Upon arrival he found the two operators therein working on patrons and no master cosmetologist present. One of the operators advised the inspector that there was no master cosmetologist on duty that day and the person managing the shop had not been present for some three weeks. The respondent herein, Ms. Hauser, is not a certified operator. From the foregoing, it is concluded that Betty J. Hauser, as owner of the Golden Touch Hair Stylists is guilty as alleged. It is therefore,


RECOMMENDED that Betty J. Hauser be issued a letter of reprimand and advised that further incidents of this nature could lead to revocation of her license to operate the beauty salon.
