RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K.N. Ayers held a public hearing in the above matter on June 16, 1975, in Ft. Lauderdale, Fla.


APPEARANCES: Ronald C. LaFace, Esquire, Post Office Box 1752, Tallahassee, Florida, for the Board of Cosmetology.


By this complaint the Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Dominico Marchetta and Dominic, Inc., d/b/a Dominic's Hair Salon, on the grounds that he did, on November 19, 1974, allow William D. Sullo to practice cosmetology in his shop without having a Florida cosmetology license in violation of Section 477.02(6), Florida Statutes. Exhibit 1, receipt for Notice of Hearing sent by certified mail, was admitted into evidence.


During a routine inspection of Dominic's Hair Salon the inspector for the State Board of Cosmetology found William J. Sullo working as a cosmetologist on an expired permit. Sullo had been issued the permit upon graduation from cosmetology school and had taken the exam for a cosmetology license. He had failed to pass this exam which had the effect of terminating his permit. Mr.

Marchetta was not aware the permit had expired when Sullo failed the exam.


From the foregoing, the Hearing Officer concludes that the respondent is guilty as charged. It is further concluded that this failure to comply with Section 447.02(6), Florida Statutes, was inadvertent on the part of the respondent. It is therefore,


RECOMMENDED that Dominico Marchetta and Dominic, Inc., d/b/a, Dominic's Hair Salon be issued a letter of reprimand and the case closed.
