RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by it's duly designated hearing officer, K. N.Ayers held a public hearing on the above matter on June 17, 1975, in Ft. Lauderdale, FL.

By this complaint the Florida State Board of Cosmetology Seeks to revoke, annul, withdraw or suspend the license of Gerdah Drews, d/b/a Moorings Beauty Salon on the grounds that on January 30, 1975 she did allow Dorothy Roach to practice cosmetology in her salon without having a Florida cosemtology license in violation of Section 477.02(6), Florida Statutes. Exhibit 1, * for Notice of Hearing sent by certified mail, was admitted into evidence.


In an Election of Remedies form signed and sworn to Ms. Gerdah Drews on June 6, 1975, she entered a plea of no contest and attached a letter of explanation. In her explanation Mrs. Drews admitted that Dorothy Lee Roach had started to work for her on a part-time basis in October 1974 where the duties consisted of answering the telephone and cleaning up. At the time Mrs. Roach held a California cosmetology license. Her husband was unemployed so she needed to work to obtain money to enable her to accumulate funds to apply for licensing in the State of Florida. Mrs. Drews also indicated that she realized she had violated the provisions of the Florida Statutes by allowing Mrs. Roach to work, but at the time Mrs. Drews was suffering ill health and at the time of the violation was in the hospital following an operation for a malignancy when the first of two violations were charged against Mrs. Drews the second violation occurred two days after she had received notice of the first violation and at the time she had allowed Mrs. Roach * a patron whose appointment was made prior to the notification of the previous violation.


From the foregoing it is concluded that Gerdah Drews, d/b/a Moorings Beauty Salon, holding license no. 9847, is guilty of violation of Section 477.02(6), Florida Statutes.


It is further concluded that this is the first violation of cosmetology laws that have ever been charged against Mrs. Drews and that she has at all times attempted to comply with the provisions of the Florida Statutes relating to cosmetology and its regulations issued by the Board of Cosmetology.

IT IS ORDERED that Mrs. Gerdah Drews d/b/a Moorings Beauty be issued letter of admonition.
