RECOMMENDED ORDER


A hearing was held in the above-captioned matter, after due notice to the parties, at Fort Lauderdale, Florida, on June 29, 1976, before the undersigned Hearing Officer.

ISSUE PRESENTED

Respondent's alleged violation of Section 477.02(6), Florida Statutes. Counsel for Petitioner announced that he had been unable to serve

Respondent with a copy of the Administrative Complaint and Notice of Hearing. He further stated that Respondent no longer holds a Certificate of Registration to operate a cosmetology salon because Tippie's Beauty salon which she formerly operated is no longer in business. He further stated that he had no objection to a dismissal of the charge.


CONCLUSIONS OF LAW


  1. Petitioner alleges that Respondent permitted one Kathy Kadick to practice cosmetology in her salon without having a Florida cosmetologist license. The Notice of Violation was dated April 26, 1975. The Petitioner seeks to suspend or revoke Respondent's salon Certificate of Registration No. 20129 OB for violation of Section 477.02(6), Florida Statutes.


  2. In view of the fact that Respondent no longer holds an active Certificate of Registration and since there are no provisions in the applicable

statutes or regulations providing for renewal or reactivation of such a Certificate, it is concluded that the allegation should be dismissed.


RECOMMENDATION


That the allegation against Respondent be dismissed.
