FINAL ORDER OF DISMISSAL


The Administration Commission ("Commission") hereby dismisses the above cited proceeding pursuant to Sumter County's Suggestion of Mootness filed on March 16, 2000, based upon the following:


  1. On January 12, 2000, the Administration Commission received a Recommended Order issued by the Division of Administrative Hearings in the above cited proceeding. The subject proceeding involves a challenge to the small scale development amendment adopted by Sumter County on May 11, 1999. The small scale development amendment was adopted through Sumter County Ordinance Number 99-15.


  2. On March 15, 2000, Sumter County filed a Suggestion of Mootness notifying the Administration Commission of the repeal of Sumter County Ordinance Number 99-15. The County suggests the repeal of the subject ordinance renders the proceeding before the Administration Commission moot.


  3. On March 24, 2000, the Administration Commission requested the remaining parties to the proceeding; Petitioners

Thomas Wiley, G. Anthony Rish, Samuel F. Slaughter, III, and Louise L. Slaughter and Intervenor Hi-Tech Metals, Inc., to file a response to Sumter County's Suggestion of Mootness on or before April 7, 2000. No responses have been received from the parties as of this date.


Based upon the foregoing, it is hereby ORDERED AND ADJUDGED that the above proceeding is dismissed.


Any party to this order has the right to seek judicial review of the order pursuant to section 120.68, Florida Statutes, by the filing of a Notice of Appeal pursuant to Rule 9.110, Florida Rules of Appellate Procedure, with the Clerk of the Commission, Office of Planning and Budgeting, Executive Office of the Governor, The Capitol, Room 2105, Tallahassee, Florida 32399-0001; and by filing a copy of the Notice of Appeal, accompanied with the applicable filing fees, with the appropriate District Court of Appeal. Notice of Appeal must be filed within 30 days of the day this order is filed with the Clerk of the Commission.
