FINAL ORDER

THIS CAUSE is before me for issuance of a Final Order. The Agency for Health Care Administration (Agency) issued a letter dated December 24, 2009 to Valentine A. Duribe, M.D. (Respondent) informing him that he was being terminated from participation in the Medicaid Program due to an overpayment from a Final Order dated July 10, 2009 that was not paid.

The Respondent requested and was granted a formal hearing to challenge his termination from the Medicaid Program. Before a formal hearing could be held in this matter the Respondent entered into a repayment plan with Finance & Accounting to repay the overpayment that was the cause of his being terminated from the Medicaid Program. Therefore, Respondent was not terminated from the Medicaid Program. The matter is now moot.

Based on the foregoing, the request for a hearing is dismissed and the file is CLOSED.
