Division), after consideration of the complete record of this case on file with the Division, enters this Final Order of Dismissal.

1. On September 3, 2014, the Department issued an Administrative Complaint to Respondent, a copy of which is attached as Exhibit "1".

2. Respondent filed an Election of Rights, wherein Respondent petitioned for a Section 120.57(1), Florida Statutes, proceeding to be held before the Division of Administrative Hearings.

3. On February 6, 2015, a hearing in this cause was held before the Honorable Darren A. Schwartz, Administrative Law Judge, Division of Administrative Hearings.

4. The Honorable Darren A. Schwartz issued an Order Closing File and Relinquishing Jurisdiction based on Petitioner's intent to dismiss the Administrative Complaint with prejudice.

Based upon the foregoing, and being otherwise fully advised in the premises it is, hereby ORDERED that:

1. The Administrative Complaint in this matter is DISMISSED with prejudice.

2. This Final Order shall become effective on the date of

filing with the Agency Clerk.

·NOTICE OF RIGHT TO JUDICIAL REVIEW

A party who is adversely affected by this Final Order is entitled to judicial review pursuant to Section 120.68, Florida Statutes. Review proceedings are governed by Rules 9.110 and 9.190, Florida Rules of Appellate Procedure.
