FINAL ORDER DISMISSING PETITION FOR RELIEF FROM A DISCRIMINATORY HOUSING PRACTICE


This matter is before the Commission for consideration of the Recommended Order of Dismissal, dated June 8, 2015, issued in the above-styled case by Administrative Law Judge J. Bruce Culpepper.


Findings of Fact and Conclusions of Law


Judge Culpepper's order notes that the Commission issued a Notice of Determination of No Cause in the case and points out that the Petition for Relief makes the following statements: "At this time, I choose to accept the decision of the Florida Commission on Human

Relations .. .I'll abide by the Commission and no longer seek further legal remedy." From these statements, Judge Culpepper finds / concludes that "... apparently, Petitioner no longer desires to pursue her claim of discrimination." Consequently, the order recommends that the Commission issue a final order dismissing the Petition for Relief.

We adopt the Administrative Law Judge's finding / conclusion that Petitioner no longer wishes to pursue her claim of discrimination.


Exceptions


Neither of the parties filed exceptions to the Administrative Law Judge's Recommended Order of Dismissal.


Dismissal


The Petition for Relief and Housing Discrimination Complaint are DISMISSED with prejudice.

The parties have the right to seek judicial review of this Order. The Commission and the appropriate District Court of Appeal must receive notice of appeal within 30 days of the date this Order is filed with the Clerk of the Commission.
