FINAL ORDER OF DISMISSAL


This cause comes before the Agency for Persons with Disabilities for entry of a Final Order of Dismissal following the receipt of an Order Closing File and Relinquishing Jurisdiction, a copy of which is attached to this Final Order.

Petitioner had requested a hearing as a result of an Agency decision notice. The request was forwarded to the Division of Administrative Hearings for assignment of an Administrative Law Judge to conduct the hearing. After a hearing, Petitioner filed a Notice of Withdrawal of his Request for an Exemption for Disqualification of Emplo yment, which resulted in the issuance of the Order Closing File and Relinquishing Jurisdiction.

Therefore, based on the foregoing, the petition requesting an administrative hearing is

DENIED. The Agency action denying Petitioner ' s request for an exemption from disqualification is effective and final according to its terms. J1----

RIGHT TO APPEAL


A party who is adversely affected by this final order is entitled to judicial review. To initiate judicial review, the party seeking it must file one copy of a "Notice of Appea l" with the Agency Clerk. The party seeking judicial review must also file another copy of the "Notice of Appeal," accompanied by the filing fee required by la w, with the First District Court of Appeal in Tallahassee , Florida, or with the District Court of Appeal in the district where the party resides. Review proceedings shall be conducted in accordance with Florida Rules of Appellate Procedure. The Notices must be filed within thirty (30) days of the rendition of this final order.1

ORDER CLOSING FILE AND RELINQUISHING JURISDICTION


On April 18, 2016, an administrative hearing in this case was held by video teleconference in Fort Myers and Tallahassee , Florida, before William F. Quattlebaum, Administrative Law Judge, Division of Administrative Hearings. Both parties were represented by legal counsel. The issue presented for hearing was whether the Petitioner's request for an exemption from employment disqualification should be granted, pursuant to section 435.07, Florida Statutes (2015).


At the hearing, both parties presented testimony and evidence . A Transcript of the hearing was filed on April 29, 2016. On May 6, 2016, the Agency for Persons with Disabilities (Respondent) filed'' a Proposed Recommended Order. On May 9, 2016, the Petitioner filed a Notice of Withdrawal of his Request for an Exemption for Disqualification of Employment. Based upon the foregoing, it is hereby,


ORDERED that:


Jurisdiction is relinquished to the Respondent for entry of an appropriate Final Order. The file of the Division of Administrative Hearings is CLOSED.
