FINAL ORDER
THIS CAUSE is before the State of Florida, Agency for Health Care Administration ("the Agency" ) concerning the preliminary approval of Certificate of Need ("CON") application No. 10568 submitted by North Florida Regional Medical Center, Inc. in the first Hospital Beds and Facilities batching cycle of 2019 for a new 42-bed psychiatric specialty hospital in District 3, Alachua County, Florida.
CON Application No. 10568 sought to move 33 adult psychiatric beds and add 9- beds from published need to establish a 42-bed psychiatric hospital in health planning District 3, Alachua County, Florida.
The Agency published a notice of its decision granting the preliminarily approval of CON application No. 10568 in the Florida Administrative Register, Volume 45, Number 112, on June 10, 2019.
On July 1, 2019, Shands Teaching Hospital and Clinics, Inc. timely filed a petition

challenging the approval as adversely affecting its substantial interests as an existing provider of adult psychiatric services in District 3. The Petition was referred to the Division of Administrative Hearings for a de nova review of the decision through a formal administrative hearing.
On August 12, 2019, Shands Teaching Hospital and Clinics, Inc. voluntarily dismissed its petition.
On August 14, 2019, the Administrative Law Judge entered an Order Closing File and Relinquishing Jurisdiction to the Agency.
It is therefore, ORDERED
The petition for formal hearing is dismissed .
The approval of CON application No. 10568 is UPHELD and adopted as the final Agency decision.

NOTICE OF RIGHT TO JUDICIAL REVIEW
A party who is adversely affected by this Final Order is entitled to judicial review, which shall be instituted by filing the original Notice of Appeal with the Agency Clerk of AHCA, and a copy along with the filing fee prescribed by law with the District Court of Appeal in the appellate district where the Agency maintains its headquarters or where a party resides. Review of proceedings shall be conducted in accordance with the Florida appellate rules. The Notice of Appeal must be filed within 30 days of the rendition of the order to be reviewed.
