BLAZY, R.Ph. ° RESPONDENT. .. fy - ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as “Petitioner,” and files this Administrative Complaint before the Board of Pharmacy against DAVID S. BLAZY, RPH,, hereinafter referred to as “Respondent,” and alleges: 1. Petitioner is the state agency charged with regulating the practice of pharmacy , pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 465, “Florida Statutes. 4 2, Pursuant to the authority of Section 20.43(3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration, hereinafter referred to as the “Agency,” to’ provide consumer complaint, investigative, and prosecutorial services required by ~~ the Division of Medical Quality Assurance, councils ot board, as appropriate, including the _ issuance of emergency orders of suspension or restriction. During an investigation predicated on the receipt of a memorandum from the Board of Pharmacy, which included a notice from the National Association of Board of Pharmacy, it was discovered that the Respondent was disciplined by the Ohio Board of Pharmacy (Docket No. D-961203-020) by revocation of his pharmacy license (# 03-1-17436) in that Jurisdiction due to illegal sale of drugs on or about January 28, 1989; theft of drugs from the ‘pharmacy of his employment, impairment by and/or addiction of drugs, permitting the use of his name to and/or having a professional connection with a an ‘illegal practitioner of pharmacy, and otherwise unprofessional and dishonest conduct in the practice of pharmacy during the period of June 28, 1995, through November 26, 1996. 6. The conduct of the Respondent as aforesaid is contrary to the provisions contained in Section 465.016(1)(h), Florida Statutes, by being disciplined by another jurisdiction _ by the revocation of his license to practice pharmacy.
