In two audit letters dated November 15, 2000, the Petitioner was informed the Agency i is seeking a refund of Medicaid overpayments. The audit letters contained full disclosure and notice ‘regarding the Petitioner's a administr ative hearing and due process ‘rights. The Petitioner requested a formal administrative hearing and subsequently withdrew the requests. By withdrawing the requests for a formal administrative hearing, the Petitioner has chosen not to dispute the facts set forth in the audit letters. Therefore, those facts are hereby deemed admitted and form the basis for the existence of the overpayments determined in the audits. The Agency for Health Care Administration is now due a refund of the Medicaid overpayments. BASED on the foregoing, the Petitioner is directed to refund the sum of $116,350.
