CRAYTON, ; LFS -Cluse ok Respondent. / FINAL ORDER WHEREAS, by letter dated January 25, 2001, the Superintendent of Schools for Pinellas County, Florida, recommended to the Pinellas County School Board that the Respondent, Freddie R. Crayton, be dismissed from his employment for violations of School Board Policy 8.25 (1)(v), which constitute grounds for his dismissal. WHEREAS, on February 6, 2001, the Respondent requested an administrative hearing; which hearing was placed in abeyance pending the outcome of his criminal trial, and WHEREAS, on August 27, 2003, at his criminal trial the Respondent was adjudicated guilty of sexual battery on two (2) victims over whom he had custodial authority while employed by the Florida Youth Academy in 2000, and WHEREAS, on October 9, 2003, Circuit Court Judge Brandt Downey sentenced. the Respondent to five (5) years in prison and ten (10) years probation; a condition of his probation to include: “You are not to be employed by or volunteer at any school, daycare center, park, playground or other places where children regularly congregate”, and WHEREAS, on December 2, 2003, Administrative Law Judge Lawrence P. Stevenson, Division of Administrative Hearings, entered an Order finding that the Respondent’s “adjudication of guilt for sexual battery renders him ineligible to occupy a position of trust or responsibility in the school system”, and thereby relinquished the Respondent's case to the School Board for entry of a Final Order dismissing him from his employment, and WHEREAS, this Board sitting as a quasi-judicial body, and having reviewed the entire record of the case including the Petitioner’s Motion for Summary Judgment, the Administrative Law Judge's Order Closing File, and the Proposed Final Order, it is hereby ORDERED AND ADJUDGED that the Administrative Law Judge's Order Closing File dated December 2, 2003, attached hereto as Exhibit “A” and incorporated herein, be adopted, and that the Respondent be dismissed from his employment effective January 14, 2004. ORDERED AND ADJUDGED, that the Respondent is hereby notified of the right to appeal this Order to the Second District Court of Appeal by filing notice of the intent to do so upon the Clerk of the Court and the Clerk of the School Board within thirty (30) days of the date of this Order.
