PARKER, Respondent. / ADMINISTRATIVE COMPLAINT Department of Business and Professional Regulation, Division of Pari-Mutuel Wagering (hereinafter "Petitioner"), files this Administrative Complaint against Craig A. Parker (hereinafter "Respondent"), and alleges as follows: 1. Petitioner is the state agency charged with regulating the practice of pari-mutuel wagering, pursuant to Section 20.165, Florida Statutes, and Chapter 550, Florida Statutes. 2. At all times material hereto, Respondent held an Unrestricted "U1" Professional pari-mutuel wagering occupational license, number 0909628-1081, issued by the Division. 3. On October 20, 1999, pursuant to a contract to purchase two horses, David Spicer wrote Respondent a check for $12,000.00, for the purchase of the horses, “Pandana” and “Indian Lohr”. 4. Respondent initially failed to deliver the horse “Indian Lohr.” However, sometime prior to Mr. Spicer’s judgment against Respondent, Mr. Spicer received “Indian Lohr.” 5. Respondent failed to deliver the horse “Pandana.” WU 7] 6. Mr. Spicer demanded his money be returned to him and Respondent wrote him a check in the amount of $12,475.00, which the bank deemed “insufficient funds” when Mr. Spicer attempted to cash it. 7. Respondent subsequently wrote Mr. Spicer a second check for $12,475.00, which was also dishonored by the bank. 8. On January 24, 2000, David Spicer filed a civil action against Respondent in the Twelfth Judicial Circuit Court in Manatee County, Florida. The case number of this action is 2000-CC-242. 9. On March 30, 2000, County Court of the Twelfth Judicial Circuit in Manatee County, Florida rendered Final Judgment against Respondent, ordering Respondent to deliver the horse “Pandana” to Mr. Spicer within 30 days, or pay $9,288.83, which included the principal of $8,220.00, prejudgment interest, court costs, and attorney’s fees. 10. Respondent has neither paid the judgment of $9,288.83, which was awarded against him or provided the horsé to Mr. Spicer. 11. Section 550.105(6), Florida Statutes, states: The division may deny, revoke, or suspend any occupational license if the applicant therefor or holder thereof accumulates unpaid obligations or defaults in obligations, or issues drafts or checks that are dishonored or for which payment is refused without reasonable cause, if such unpaid obligations, defaults, or dishonored or refused drafts or checks directly relate to the sport of jai alai or racing being conducted at a pari-mutuel facility within this state. Based on the foregoing, Respondent has violated Section 550.105(6), Florida Statutes, by accumulating unpaid obligations related to the purchase of racing animals. WHEREFORE, Petitioner respectfully requests the Division enter an Order imposing one or more Of the following penalties as specified in Section 550.105(6), Florida Statutes: revoke, suspend, deny or declare ineligible the occupational license of Respondent.
