YOU ARE HEREBY NOTIFIED that after twenty one (21) days from the receipt of this Complaint the Agency for Health Care Administration (hereinafter referred to as "Petitioner") intends to impose an administrative fine in the amount of Two Thousand Dollars ($2,000) upon Century Professional Recruitment, Inc., d/b/a Century Health Services, (hereinafter referred to as "Respondent"). As grounds for this administrative fine the Petitioner alleges as follows: 1. Petitioner has jurisdiction over Respondent by virtue of the provisions of Chapter 400, Part IV, (F.S.). 2. Respondent is licensed to operate at 115 Boca Raton Road, Boca Raton, Florida 33432, as a Home Health Agency in compliance with Chapter 400, Part IV, F.S., and Rule 594-8, | Florida Administrative Code, (F.A.C). 3. On or about December 05, 2000, during a fifth revisit conducted by personnel from the Agency for Health Care Administration revealed that Respondent was operating a Home Health Agency as follows: -(a) | Based on interview and observations, the agency location was not readily available to the public: (1) = On 6/14/00 the surveyor arrived at the agency at 12:45 p.m. All doors to the building were locked and no one answered the bell (which was loud enough to be audible outside the building). The surveyor remained at the location until 2:30 p.m. The doors remained locked and the bell went unanswered. , (2) At approximately 2:45 p.m., the surveyor called the telephone number listed for the agency location in the local directory, There was no answer, no answer machine, and no answering service. The surveyor then called the telephone number listed for the corporate office, which is located in another county. The call was answered on the first ring and when the surveyor asked for the hours of operation of the Boca Raton office, was informed “Monday thru Friday from 9 to 5”, The surveyor also verified the name of the administrator, but was informed that the office did not know where she was, however they would beep her. At 3:00 p.m. the surveyor again called the Boca location. Again there was no answer, machine, or service. (3) The surveyor reached the administrator by phone at approximately 3:15 p.m. The administrator stated that she was at the Boca location and would be there until 5:00 p.m. The administrator stated that there was no one in office and the number in the phone book was the “back line”, the number from the previous location in Boynton Beach is the main number, even though it is listed in the telephone directory. (2a) On the 10/25/00 re-visit this deficiency remained out of compliance based on the following: (1) _ The surveyor asked the clerical staff person in the office what the hours of operation were at that time. The surveyor was informed that the office was open “from about 10 a.m. until 4:30 p.m.” (2) The telephone number listed on the agency brochure and in the yellow pages was the original telephone number from when the office was located in Boynton Beach. If this number was called from the Boca Raton area, it was a long distance call. The number did not ring at the Boca Raton’s office; it was forwarded to the corporate office in Deerfield Beach (Broward County). (3a) On 12/05/00 at 9:00 a.m. the home health agency was closed. The surveyor was unable to conduct the revisit. This is in violation of Rule 59A-8.003(9), F.A.C., and is carrying, in this instance a $1,000 fine. (b) Based on record review, clinical records did not contain all the required information. The findings include: ; . (1) On 10/25/00 during a review of the closed patient records revealed that 2 of 3 records did not contain a termination evaluation of goals and instructions to the patient/care giver. (2b) On 12/05/00 survey at 9:00 a.m., the home health agency was closed and the surveyor was not able to verify if the deficiency was ever corrected. This is in violation of Rule 59A-8.022, F.A.C, carrying in this instance a $500 fine. .(c) During the 10/25/00, and based on interview, observation, and record review, the facility did not maintain files for all employees. The findings include: (1) Observation, interview, and record review revealed that the personnel records on file in the office did not include files for the administrator, associate administrator, director of nursing, associate director of nursing, and the office clerical staff member. (2) Record review revealed that 3 of 3 personnel files did not contain the results of background screening. (2c) On 12/05/00 at 9:00 a.m., the home health agency was closed and the surveyor was unable to verify if the deficiency was ever corrected, This is in violation of Rule 59A-8.0185, F AC, carrying in this instance a $500 fine. 4. The above referenced violation constitutes grounds to levy this administrative fine pursuant to Section 400.474, (F.S.), in that the Respondent has violated the minimum standards, tules and regulations promulgated by the Agency under Chapter 400, Part IV, (F.S.) cane np es a RS eh i a ERR ARRAN Ok ee the anni a 5. Respondent is notified that it has a right to request an administrative hearing pursuant to Section 120.569, (F.S.); to-be represented by counsel (at its expense); to take testimony, to call and cross-examine witnesses, to have subpoenas and/or subpoenas duces tecum issued, and to present written eviderice or argument if it requests a hearing. In order to obtain a formal proceeding, your request for an administrative hearing must conform to the requirements in Rule 28-106.201, (F.A.C.), and must state which issues of material fact you dispute. Failure to dispute material issues of fact in your request for a hearing may be treated by the Agency as an election by you of an informal proceeding under Section 120.57(2), (F.S.) RESPONDENT IS FURTHER NOTIFIED THAT FAILURE TO REQUEST A HEARING WITHIN TWENTY ONE (21) DAYS OF RECEIPT OF THIS COMPLAINT WILL RESULT IN AN ADMISSION OF THE FACTS ALLEGED IN THE COMPLAINT AND THE ENTRY OF A FINAL ORDER BY THE AGENCY.
