Petitioner, Charlie Christ, as Commissioner of Education, by y and through his undersigned counsel, hereby files this, his Administrative Complaint, against Patricia Heard. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s Educator’s Certificate pursuant to Sections 231.2615 and 231.262, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Profession in Florida, said sanctions more specifically set forth in Sections 231. 2615(1) and 231.262(6), Florida Statutes. Loe B'S } JURISDICTION _ 1. __ Respondent holds Florida Educator’s Certificate 153502, which is valid through 2004, 2. At all times pertinent hereto, the Respondent was employed by the Campbell Middle School, as a drop out prevention teacher. 7 w) Y MATERIAL ALLEGATIONS 3. On or about June 3, 1999, during a meeting of the NAACP, Respondent made comments to those present at the meeting regarding a student, K.E., the student’s grades, and other confidential information. This information was shared at a public meeting with individuals not affiliated with the school system, or otherwise related to the education of KE. The information that was shared cast K.E. in a negative light, and was subsequently found to be untrue. “ STATUTORY VIOLATIONS — Count I: The Respondent is in violation of Section 231.2615(1)(9, Florida Statutes, in that, upon investigation, Respondent has been found guilty of conduct which seriously reduces her effectiveness as an employee of the school board. Count I: ~ The Respondent i is in Violation of Section 231. 2600, Florida Statutes, in that Respondent has violated ‘the Principles of Professional Con uct or the Education Profession prescribed by the State Board of Education Rules. Paar) RULE VIOLATIONS CountIM: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(e), Florida Administrative Code, in that Respondent has intentionally exposed a student to unnecessary embarrassment or disparagement. - ag , vw V) | CountIV: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(f), Florida Administrative Code, in that Respondent has violated or denied a student’s legal rights. Z Count V: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(i), Florida Administrative Code, in that Respondent has failed to keep in confidence personally identifiable information obtained in the course of professional services. ' Count Vi: The allegations of misconduct set forth herein are in violation of Rule 6B- _ 1.006(5)(a), Florida Administrative Code, in that Respondent has failed to maintain honesty in — _ all professional dealings. WHEREFORE, Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 231.2615(1) and _ 231.262(6), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of the’pr tice, istrative fine, suspension of the Teaching Certificate. -- not to exceéd three years, permanent revocation of the Teaching Certificate, or a combination thereof, forthe reasons set forth herein, and in accordance with the explanation and Election of } Rights forms which are attached hereto and made part hereof by reference.
