FINAL ORDER
Having reviewed the Notice of Intent letter dated May 25, 2001,
and all other matters of record,
the Agency for Health Care
Administration (“Agency”) finds and concludes as follows:
FINDINGS OF FACT
1. The Agency issued a Notice of Intent to deny renewal of
license as a result of an annual licensure survey visit conducted on
july 19, 2000 and four (4) consecutive follow-up visits conducted on
October 4, 2000, November 27, 2000, January 8, 2001, and March 27,
2001.
2. According to Section 400.474(1) and (2)(a), Florida
Statutes, the Agency for Health Care Administration may deny a
license based o failure to comply with state law and rules.
3. The Respondent was served with a Notice of Intent to
Deny letter on May 25, 2001 by U.S. Certified Mail, return receipt
requested. The Respondent was advised of its right to request an
administrative hearing and was provided with an Election of Rights
form and an Explanation of Rights form.
4. The Respondent disputed the allegations in the Notice of
Intent to Deny letter and filed a petition for a Formal Administrative
Hearing.
5. Subsequently, the Respondent withdrew its request for a
hearing and filed a Notice of Voluntary Dismissal.
3. The facts as alleged and found, establish that:
The Agency issued a Notice of Intent to deny license
renewal as a result of an annual licensure survey visit
conducted on July 19, 2000 and four (4) consecutive
follow-up visits conducted on October 4, 2000, November
27, 2000, January 8,, 2001 and March 27, 2001. According
to Section 400.474(1) and (2)(a), Florida Statutes the
Agency may deny a license based on failure to comply with
state law and rules.
CONCLUSIONS OF LAW
1. The Agency has jurisdiction over Respondent pursuant to
the provisions of Chapter 400, Part IV, Florida Statutes (2001).
2. As alleged in the Notice of Intent to Deny letter, the
Respondent is in violation Section 400.474(1) and (2)(a), Florida
Statutes.
3. The Respondent, Teamworks Nursing Services, submitted
a Notice Of Voluntary Dismissal and expressly waived its right to a
Formal Administrative Hearing
4. A Final Order adopting the allegations and conclusions set
forth in the Notice of Intent letter and imposing the sanction is sought.
Based on the foregoing findings of fact and conclusions of law, it
ORDERED:
