OLSON, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL _ REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against LARRY S. OLSON, ("Respondent"), and says: 1, Petitioner is the state agency charged with regulating the Practice of contracting pursuant to Section 20. 165, Florida Statutes, and ‘Chapters 455 and 489, Florida Statutes. 2. Respondent i is, and has been at all times material hereto, a Certified Roofing ; Contractor in n the State of Florida having been issued license number ce 057275, currently in in delinquent status, 3. Section 489.1195(a), Florida Statutes, provides that all primary qualifying agents for a business organization are jointly and equally responsible for supervision of all operations of the business organization; for all field work at all sites; and for financial matters, both for the . organization in general and for each specific job. 6. Respondent failed to obtain a certificate of authority for Comtec Coatings Co, 7. On or about March 29, 1996, Respondent, doing business as Comtec Coatings Co. (hereinafter “Comtec”), contracted with Judith Kopp (hereinafter “Kopp”), to coat Kopp’s roof with urethane foam at her residence located at 1010 Terry Drive, Melbourne, Florida 32935. 8. The contract price was $8,600.00 and Respondent was paid in full. . 9. The contract included a five-year warranty for workmanship and material. 10. Respondent failed to provide notification of the Construction Industries Recovery Fund. 11. In or around October 2000, the roof began to leak and Kopp received advice from a retired contractor that the roof would need to be completely replaced and that it was becoming a dangerous condition in that the entire roof was covered with bubbles and pockets of water. 12. Estimates to repair the roof are $20,500.00 and $30,000.00. 13. Based on the foregoing, the Respondent violated Section 489.129(1)(i), Florida Statutes, by failing in any material respect to comply with the provisions of this part or violating a rule or lawful order of the board. | OUNT II 17. Petitioner realleges and incorporates the allegations set forth in Paragraphs One through Thirteen as though fully set forth herein. . | 18. Based on the foregoing, the Respondent violated Section 489,129(1)(m), Florida Statutes, by committing incompetency or misconduct in the practice of contracting, by failing to honor a warranty.
