pursuant to Section 20, 165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. eee

4. Respondent’s last known address is 2701 Northeast 5" Avenue, Boca Raton, oy
: Florida, 33431.
5. On or about ee 15, 2000, Respondent contracted with Michael
; Degrandchamp (hereinafter “Degrandchamp”), for the installation of an ABL cradle lift, pilings,
walk platform, gull cradle, and electrical upgrades on Degrandchamp’ $ property located at 1551
Southwest 6 Terrace, Boca Raton, Florida.
6. The contract Price was $14,310.00 and Respondent was paid $5,000.00.
77 _ Respondent failed to obtain a permit for the Project z and failed to begin any work
on the project.
8. During an investigation by the Palm Beach County Construction Industry
Licensing Board, Respondent offered to refiund Degrandchamp $3,800.00, however
Degrandchamp refused the offer. : :
9. Section 489.105(3), Florida Statutes, provides that a “contractor” is a -
person who, for compensation, undertakes to, submits a bid to, or does himself or herself or by. -
others construct, repair, alter, remodel, add to, demolish, subtract from, or improve any building .

10. Section 489. 1053)@), Florida Statutes, Provides that a “general contractor”
means a contractor whose s services are e unlimited as to type of work which he or she may do, who

13.00 Based on the foregoing, the Respondent has violated Section 489, 127, Florida
, Statutes, which Provides that no person shall engage in the business or act in the capacity of a
contractor without being duly reyitered or certified to advertise himself or a business
organization as available to engage in the business or act in the capacity of a contractor without
being duly registered or - certified.
WHEREFORE, Petitioner respectfully requests the entry of an Order i imposing one or”
more of the following penalties: an in administrative fine n not to exceed $5, 000. 00 per incident;
