COMES NOW. the Petitioner. Department of Health. hereinafter referred to as “Petitioner”,
and files this Administrative Complaint before the Board of Dentistry against. FRANCISCO
JIMENEZ, D.D.S.. referred to as "Respondent", and alleges:
COUNT ONE
1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the
practice of Dentistry pursuant to Section 20.43, Florida 2 Statutes, Chapter 456. Florida Statutes.
(formerly Chapter 455, Part Il; see Chapter 2000-160. Laws of Florida), and C hapter 466, Florida
Statutes. Pursuant to Section 20. BENE), Florida Statutes. the Department has contracted with
the © Agency for Health Cc Ad inistrati By to provide consumer complaint, investigative. and
prosecutorial services required by the | Division of Medical Quality Assurance. councils, o
boards, as appropriate.
2. Respondent is, and has been at all times material hereto, a licensed dentist in the State of
Florida. having been igsued license number DN 13881. Respondent's last known address is 12798
West Forest Hill Blvd, Suite 305, Wellington, Florida 33414,

3. On or about June. 28, 2000, C.L.. a minor whose legal guardians are G.L. and L.L..
presented to the Respondent for an initial exam, two bitewing x-rays, Prophylaxis, and fluoride
treatment.
4. On or about J uly 5, 2000, Respondent extracted C.L.’s teeth E and F.

7. Based on the foregoing. the Respondent's license to practice dentistry in the State of
Florida is subject to discipline pursuant to Section 466.028 (1) (x), Florida Statutes, for being
guilty of incompetence or negligence by failing to meet the minimum standards of performance in
diagnosis and treatment when measured against generally prevailing peer performance, including.
but not limited to, the undertaking of diagnosis and treatment for which the dentist is not qualified
by training or experience or being guilty of dental malpractice.

8. Petitioner realleges Paragraphs I and 2.
9. On or about October 16, 2000, G.L.. the guardian of C.L., Tequested C.L.*s patient
records from Respondent.
10. Respondent failed to provide the patient records to GL.
11. Based on the foregoing, the Respondent's license to Practice dentistry in the State of
Florida is subject to discipline pursuant to Section 466.028( 1)(n), Florida Statutes. for failing to
