By. letter, dated August : 16, 2001, ‘the Agency’ 's Health Facility Regulation Bureau Chief, Jeffrey Gregg, notified St. Luke’s that the letter did not constitute a valid Letter of Intent because the project was exempt from review pursuant to 408.036(3)(i), Florida Statutes. — On September 4, 2001, St. Luke’s filed a Petition for Formal Administrative Proceedings. On September 28, 2001, the Petition was forwarded to DOAH by the Agency and assigned to an Administrative Law Judge (“ALJ”). red to confer and advise the ALJ i in writing “no later: than: February 7 7, 2002, ‘as’ “to! the ‘status of the: case. ‘The Order : provided that the failure t to file a ‘status 5 report will result i in ‘the conclusion that On denier 9, 2008, the ALJ filed an, Order to Show Cause which s stated : ; _ the parties had not filed, a status report The Order to Show Cause: | gave the. parties ten days to. file a response to show. why the DOAH case should not be . closed: No résponsé was filed by. either party.
