ADMINISTRATIVE COMPLAINT
State of Florida, Department of Business and Professional Regulation, Division of Real
Estate (“Petitioner”) files this Administrative Complaint against Thomas F. Newman and Jaguar
Realty & Consulting, Inc. (“Respondent”) and alleges:
ESSENTIAL ALLEGATIONS OF MATERIAL FACT
1. Petitioner is a state government licensing and regulatory agency charged with the
“responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State
of Florida, in particular Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes
and the rules promulgated pursuant thereto.
2. Respondent Thomas F. Newman is and was at all times material hereto a licensed
Florida real estate broker, issued license number 0064029 in accordance with Chapter 475 of the
Florida Statutes. The last license issued was as an active broker at Jaguar Realty & Consulting
Inc., 4306 Plaza Gate Lane S. #201, J. acksonville, Florida 32217.

3. Respondent Jaguar Realty & Consulting, Inc. is and was at all times material hereto a
_ corporation registered as a Florida real estate broker having been issued license number 1002260 in
accordance with Chapter 475 of the Florida Statutes. The last license issued was at the address of 4306
Plaza Gate Lane S. #201, Jacksonville, Florida 32217
4. At all times material hereto, Respondent Thomas F. Newman was licensed and operating
as qualifying broker and officer of Respondent Jaguar Realty & Consulting, Inc.
5. Respondents represented buyers, Corey and Shannon Robbins, as a single agent in the
purchase of a home.
6. Respondent facilitated a purchase and sale contract for the property, subject to a loan in
the amount of ninety-five percent of the contract price. A copy of the contract is attached hereto and
incorporated herein as Exhibit 1.
7. Respondent collected $2,000 from the buyers to be held in escrow as an earnest money
deposit.
8. The buyers failed to qualify for a loan in the amount specified in the contract.
9. On July 24, 1999, the seller’s agent sent a letter, via facsimile, to Respondent stating that
seller made a demand on the money held in escrow. A copy of the letter is attached hereto and
incorporated herein as Exhibit 2.
10. Respondent received the facsimile from the seller’s agent the same day. A copy of the
facsimile is attached hereto and incorporated herein as Exhibit 3.

11. On July 27, 1999, Respondent wrote a check to the buyers for $2,000. A copy of the
check is attached hereto and incorporated herein as Exhibit 4.
12. Respondent disbursed the escrow monies to the buyers while a demand on the escrow
was pending. °
13. On or about September 21, 1999, approximately two months after receiving demand
for the deposit, Respondent requested Petitioner to issue an escrow disbursement order. A copy
of the request is attached hereto and incorporated herein as Exhibit 5.
COUNT I -
Based upon the foregoing, Respondent Thomas F. Newman is guilty of failure to maintain trust
funds in the real estate brokerage escrow bank account“or some other proper depository until
disbursement thereof was properly authorized in violation of Section 475.25(1)(k), Florida Statutes.

Based upon the foregoing, Respondent Thomas F. Newman is guilty of failure to account or
deliver funds in violation of Section 475.25(1)(d)1, Florida Statutes.
COUNT I
Based upon the foregoing, Respondent Thomas F. Newman is guilty of failure to provide
prompt written notification to the Commission of an escrow fund dispute in violation of Section
475.25(1)(d)1, Florida Statutes.

COUNT IV
Based upon the foregoing, Respondent Jaguar Realty & Consulting, Inc. is guilty of failure to
maintain trust funds in the real estate brokerage escrow bank account or some other proper depository
until disbursement thereof was properly authorized in violation of Section 475.25(1)(k), Florida
Statutes. .
COUNT V
Based upon the foregoing, Respondent Jaguar Realty & Consulting Inc. is guilty of failure to
account or deliver funds in violation of Section 475.25(1)(d)1, Florida Statutes.
COUNT VI
Based upon the foregoing, Respondent Jaguar Realty & Consulting, Inc. is guilty of failure
to provide prompt written notification to the Commission of an escrow fund dispute in violation of
Section 475.25(1\(a)1 ; Florida Statutes. .
.WHEREF ORE, Petitioner respectfully requests the Florida Real Estate Commission, or
the Department of Busines and Professional Regulation, as may be appropriate, to issue ¢ a Final
Order as final agency action finding the Respondent(s) guilty a as charged. The penalties which
may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the
severity of the offense(s), include: revocation of the license or registration or permit; suspension
of the license, registration or permit for a period not to exceed ten (10) years, imposition of an
