Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. — 2. Respondent is, and has been at all times material hereto, a Certified Roofing Contractor in the State of Florida, having been issued license number CC C057317. 3 Respondent's last known address is 6671 West Indiantown Road, Suite 56-381, 3. Jupiter, Florida, 33458. 4. At all times material hereto, Respondent was the licensed qualifier for Duane Thomas, Inc., qualified business license number QB 0003747. Section 489.1195(a), for a business organization are jointly and equally responsible for supervision of all operations of ~ the business organization; for all field work at all sites; and for financial matters, both for the organization in general and for each specific job. - 6. _ Onor about March 6, 2000, Respondent, doing business as Duane Thomas, Inc., contracted with Jose Revenga, Vice-President of Marina Bay Condominium Association, to re roof the Homeowner’s Association carports. \ 7. The contract price was $31,900.00, and Respondent was paid a deposit of $15,950.00. 8. Respondent failed to provide his license number on the contract. 9. Respondent began work on the project and worked for two days on or about May 23 and May 24, 2000. 10. Ono or about May 24, 2000, a Community Association Manage for Marina Bay _ Condominium Association, stopped work on the project because the work was not being done to contract specifications, and discovered that no permits had been obtained for the project. Petitioner realleges and incorporates the allegations set forth in Paragraphs One through Ten as though fully set forth herein. 12. — Section 489.119(6)(b), Florida Statutes, provides that the registration or certification number of each contractor or certificate of authority number for each business organization shall appear in each offer of services, business proposal, bid, contract, or advertisement, regardless of medium, as defined by board“ule, used by that contractor or business organization in the practice of contracting. 13. Based on the foregoing, the R on 489.129(1)(i), Florida is Statutes, by failing in any material respect to comply with the provisions of this part or violating a mule or lawful order of the board. | — ee | a COUNT II 4, Petitioner realleges and incorporates the allegations set forth in Paragraphs One through Ten as though fully set forth herein. “15. Based on the foregoing, the Respondent violated Section 489. 129(1)(0), Florida Statutes, by proceeding on any job without obtaining applicable local building department permits and inspections. Based on the foregoing, the Respondent violated Section 489. 129(1)(m), Florida Statutes, by committing incompetency or misconduct in the practice of contracting. WHEREFORE, Petitioner tespectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or - registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5, 000: per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227 0), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder. page eee cere re Signed this 2 ; tt. of Kt af ELLE Diam By Rote a Gat COUNSEL FOR DEPARTMENT: Theodore R.
