ANGLICKIS, Respondent. / ADMINISTRATIVE COMPLAINT ' State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Richard A. Anglickis (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate broker, issued license number 0001869 in accordance with Chapter 475 of the Florida Statutes. 3. The last license issued was as a broker c/o American Heritage Realty, Inc., 1000 Lee Blvd. #302, Lehigh Acres, Florida 33936. FDBPR v. Richard A. At all times material to the allegations, Respondent was the broker and president of American Heritage Realty, Inc. and the president of Lee County Mortgage and Title, Inc. 5. From 1989 to at least 1999, Respondent acted as the listing and escrow agent for an installment contract of purchase and sale for property commonly known as Lot 28, block 25, unit 5, section 20, township 44 South, Range 26 East located in Lehigh Acres, Florida (subject property) between Frances R. Allman (buyer) and Andre Lambrechts (seller). A copy of the contract is attached hereto and incorporated herein as Administrative Complaint Exhibit 1. 6. On or about January 24, 1996, the seller sold the property to Southwest Florida ° Investments, Corporation. A copy of the warranty deed is attached hereto and incorporated herein as Administrative Complaint Exhibit 2. 7. Respondent was the President and a Director of Southwest Florida Investments, Corporation. 8. The buyer provided the last payment on or about July 1, 1998, requested the deed for the subject property and demanded a refund of an overpayment. 9. By letter dated November 18, 1998, LCM&T requested additional information regarding an assignment to the buyer’s Trustee from the buyer in order to transfer the deed. A copy of the letter is attached hereto and incorporated herein as Administrative Complaint Exhibit 3. 10. During the course of the official investigation it was revealed that LCM&T’s records contained a letter from the buyer notifying LCM&T of the assignment in 1990. A copy of pertinent FDBPR v. Richard A. Anglickis Case No. 98-84068 Administrative Complaint 7 correspondence is attached hereto and incorporated herein as Administrative Complaint Exhibit 4A _ and 4B. 11. As the president of LCM&T, Respondent’s office knew or should have known of the requirement for a copy of the trust agreement and obtained it at such time. 12. Investigation also revealed that at times the buyer’s payments were wrongfully credited to contract account #3835 for property purchased by William Allman, the buyer’s son, instead of to her contract account #3834. 13. LCM&T cancelled William Allman’s contract by letter dated November 27, 1995, however, the letter referenced the buyer's account #3834. A copy of the letter is attached hereto and _incorporated herein as Administrative Complaint Exhibit 5. 14. During the course’ of the official investigation, Respondent asserted that the buyer had purchased both properties and that was the basis for the error in accounting for the payments. A copy of Respondent’s written Tesponse is attached hereto and incorporated herein as Administrative Complaint Exhibit 6. 7 . | 15. By letter dated October 22, 1999, LCM&T acknowledged the buyer’s overpayment. A copy of the letter is attached hereto and incorporated herein as Administrative Complaint Exhibit 7. 16. During the course of the official investigation, Petitioner’s investigator obtained copies of the buyer’s trust agreements. 17. As evidenced from correspondence in LCM&T’s file, as of October 1999, the closing ee gee pepe eegee segge ep er one eee FDBPR v. Richard A. Anglickis . Case No. 98-84068 Administrative Complaint on the subject property had not taken place, and the buyer had not received a refund for the overpayments nor the deed. 18. The closing occurred on J. anuary 21, 2000, and Morgan & Associates Title Company disbursed funds to the buyer on or about February 25, 2000. A copy of the closing documentation is attached hereto and incorporated herein as Administrative Complaint Exhibit 8. _ COUNT I Based upon the foregoing, Respondent is guilty of dishonest dealing by trick, scheme or device, culpable negligence, or breach of trust in any business transaction in violation of Section 475.25(1)(b) of the Florida Statutes . - WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; — imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant or permitee to complete and pass additional real estate education courses; publication; or any combination of the foregoing which may apply. See § 475.25(1), Fla. Stat. (1999) and Fla. FDBPR v. Richard A. Anglickis Case No. 98-84068 Administrative Complaint Admin. Code R. 61J2-24.001. The penalties which may be imposed for violation(s) of Chapter 455 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license, registration, or permit; suspension of the license, registration, or permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense, imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or permitee to complete and pass additional real estate education courses; publication; restriction of practice; injunctive or mandamus relief; imposition of a cease and desist order; or any combination of the foregoing which may apply. The contract was given to Michelle Wiesnewski of Lee County Mortgage & Title (LCM &T) to process, collect and administer. . ; The seller, in 1995 wanted to close out 2 number of installment contracts that were bein g serviced by LCMA&T. Since the seller lived in Europe (Belgium) and spoke litte En glish, it took quite some time to negotiate the contracts. The seller actually sent his attomey te Lehigh Acres to meet with my attorney to resolve the sale and assignment of contracts of his installment lots to Southwest Florida Investment Corporation who purchased the assigned properties including the property being bought by Ms. Allman, See copy of February 27, 1996 letter enclosed from Darrell Hill, In late December of 1995 al] details were worked out and titles to the assigned properties were prepared and recorded by Attorney Hill in early 1996, In June of 1998 LOM&T began processing the contract to close in Ms. Allmans' name. AS you can see from the correspondence dated Joly 27, 1998 (copy enclosed). Ms. Allman was sending us copies of checks showing that taxes on the property had been paid in accordance with Paragraph G on the reverse side of the contract. Also, I was advised by LCMA&T that there were other discrepancies found when LCM&-T analyse Ms. Allmans account that were being addressed by them. Adding to this confusion, was Ms. Alimans' request to assign her purchase and sales agreement (copy enclosed) dated September 11, 1999, which was found in the file. Since this assignment was made to a "Trustee" a copy of the trust must be obtained from Ms.” Allman before the contract can be seat to the atomey to close. This ig a standard request made by the attorney, and tothis dare they have not yet received the trust agreement from Ms. Allman, so the contract still cannot be closed. Additionally, there js remaining confusion regarding payments made and applied to the Ovo sccounis that Ms, Allman had made and these issues were being addressed by LCOM&T, This only added to the delay in this closing. However, trom late July to early September (complaint filed on 9/1 3/98) is not an extremely long period of time to try and straighten out nearly 10 years of monthly installment payments considering the confusion of 2 contracts, Unpaid taxes, missing trustee agreements, and insuring 2 proper accounting is made to satisfy Ms. Allman, this all seems to be happening within a reasonable length of time. * HOH @5:55 pe THE WERITa GCE Croup Unfortunately, the girl servicin the LCM&T accounts is new, and unfamiliar with al] the ; & z necessary details and procedures regarding checking of all information required to close these type of transitions, Additionally, this has been a more difficult transaction to Process, But certainly2 months from the initial Tequest to vlose, to complaint filed with you Js seemingly unreasonable. And personally, in my opinion, in 2 months a Closing with RO problems would be one to talk fondly about. At this date, the Trustee Agreement has still not been provided in order to close this transaction.
