KILLORIN, Respondent. / : ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against WILLIAM J. KILLORIN, ("Respondent"), and says: . 1. Petitionér is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. 2. Respondent is, and has been at all times material hereto, a Certified Plumbing ‘ Contractor, in the State of Florida, having been issued license number CF C037144. 3. Respondent's last known address is 3308 SW 15" Street, Fort Lauderdale, Florida 33312. 4. At all times material hereto, Respondent was licensed as an individual, 5. On or about December 29, 1999, Herman R. Soto submitted an application to the State of Florida Construction Industry Licensing Board (“CILB”) to sit for the air conditioning contractor’s exam. 6. Soto’s Certification of Experience application declared that Soto possessed two (2) years experience as a workman, from approximately September 1987 through September 1989, and ten (10) years experience as a supervisor/manager, from approximately October 1989 through December 1999, for Southern Atlantic Service Corporation, Inc. (hereinafter “SASCT”). “4. On or about December 28, 1999, the Respondent signed Soto’s application for the certification examination, thereby certifying Soto’s experience to the CILB. ~ 8. The Respondent worked for SASCI from on or about April 26, 1999 through on or about May 3, 2000. 9. The Respondent only knew Soto for the time period that he worked for SASCL, which was approximately a year. 10. Section 455.227(1)(m), Florida Statutes (1999), provides: “Making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice of a profession”, is grounds for discipline. 11. The Respondent, by certifying Soto’s experience for fourteen (14) years, when the Respondent only knew Soto for approximately one (1) year constitutes a violation of Section 455.227(1)(m), Florida Statutes, 12. Based on the foregoing, the Respondent violated Section 489.129(1)(c), Florida Statutes (1999), by violating any provision of Part I of Chapter 455, cy WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder. roms Signed this I< —~_ day of , 2001.
