li a bebe on, Bk de nt rae STATE OF FLORIDA DEPARTMENT OF HEALTH DEPARTMENT OF HEALTH ~~ Petitioner, vs. Case No. 2001-05958 GIGI SETTERGREN, OL ART Pp L Respondent. / ADMINISTRATIVE COMPLAINT COMES NOW, Petitioner, DEPARTMENT OF HEALTH, by and through its undersigned counsel and files this administrative complaint before the Board of Nursing against the Respondent, Gigi Settergren, and in support thereof alleges: | 1. . Petitioner is the state agency charged with regulating the practice of nursing pursuant to Chapters 20, 456, and 464, Florida Statutes. 2. Pursuant to the authority of Section 20.43(3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative and prosecutorial services required by the Division of Medical Quality Assurance, councils or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. 3. - Respondent is and has been at all times material hereto, a licensed REGISTRED NURSE in the State of Florida, having been issued license number s RN 1755322. 02 2 140 : RRR EE REE mR nee ae me ae Bk eae Bok wath Bie 4. Respondent's last known address is 16280 Pimlico Drive East, Loxahatchee, Florida 33470, 5. On or about April 23, 2001, Respondent worked at Wellington Regional Medical Center, 10101 Forest Hill Bivd., West Palm Beach, Florida 33414. 6. On or about April 23, 2001, Respondent failed to hook up a Vancomycin pump for a patient as required by a physicians order to do so. 7. On or about April 23, 2001, a co-worker observed Respondent to be very shaky and to be glassy eyed with her pupils dilated, with trouble concentrating and looking disheveled. 8. On or about April 23, 2001, Respondent admitted that she took a Percocet. Respondent refused a mandatory employer drug screen. | 9. On or about April 23, 2001, Respondent failed multiple times to sign off orders on patients that were assigned to her. 10. On or about April 23, 2001, Respondent, on multiple occasions, recorded narcotic withdrawal and wasting when no one witnessed the wasting. 11. Based on the foregoing, Respondent is subject to discipline for violating Section 464.018(1\f), Florida Statutes, by making or filing a false report or record, which the licensee knows to be false, intentionally or negligently failing to file a report or record required by state or federal law, willfully impeding or obstructing such filing or inducing another person to do so. Such report or eect monte nop CPOE NRE I Te oeepe re records shail include only those which are signed in the nurse's capacity as a licensed nurse. ; 12. ‘Based on the foregoing, Respondent is subject to discipline for violating Section 464.018(1)(h), Florida Statutes, by unprofessional conduct, which shall include, but not limited to, any departure from, or the failure to conform to, the minimal standards of acceptable and prevailing nursing practice, in which actual injury need not be established. Unprofessional conduct is further defined in Rule 64B9-8.005(1), Florida Administrative Code, to include inaccurate recording, falsifying, or altering of a patients records or nursing progress records, employment applications or time records. WHEREFORE, Petitioner respectfully request that the Board of Nursing enter an Order imposing one or more of the following penalties: Revocation or suspension of Respondent's license, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, costs, and/or any other relief that the Board deems appropriate.
