Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular § 20.165, Fla. Stat., Chapters 120, 455 and 475, Fla. Stat., and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate broker, issued license number 3004356 in accordance with Chapter 475, Fla. Stat. 3. The last license issued was as a broker c/o Buy Free Realty, Inc., 7405 NW 57" Street, Tamarac, Florida 33319, FDBPR vs Ian J. Trumbach FDBPR Case N° 99-80422 Administrative Complaint 4. On or about March 19, 1998, Respondent Trumbach and Buyers No Fee Realty facilitated a contract for sale and purchase between Stephen and Florence Charla, sellers, and Maribel Pelayo, buyer, regarding real property located at 1911 NW 113 Way, Coral Springs, F lorida. A copy of the contract ts attached hereto, incorporated herein and made a part hereof by reference as Administrative Complaint Exhibit 1. 5. The buyer’s husband, Joseph Pelayo, was a salesperson employed by Respondent Trumbach and Buyers No Fee Realty. 6. On or about March 19, 1998, Respondent Trumbach and Buyers No Fee Realty collected from Pelayo a check in the amount of $18,000 as earnest money deposit. A copy of the check is attached hereto, incorporated herein and made a part hereof by reference as Administrative Complaint Exhibit 2. 7. Pelayo’s $18,000 earnest money deposit was placed into Respondent Trumbach’s trust account. 8. On or about April 1, 1998, prior to closing, Joseph Pelayo advised Respondent Trumbach that the buyer would not proceed with the contract and requested the release of her earnest money deposit to her attomey. 9. Respondent Trumbach delivered the $18,000 earnest money deposit to the buyer’s attorney. 10. Respondent Trumbach did not advise or obtain the consent of the sellers prior to FDBPR vs Ian J. Respondent Trumbach did not advise the Petitioner or the Florida Real Estate Commission of a good faith doubt as to whom was entitled to the deposit. 12. Fla. Admin. Code R, 61J2-10.032(1)(b) provides A broker, who has a good faith doubt as to whom is entitled to any trust funds held in the broker’s escrow account, must provide written notification to the Commission within 15 business days after having such a doubt and must institute one of the settlement procedures as set forth in s. 475.25(1)(d)1., Florida Statutes, within 30 business days after having such doubt. The determination of good faith doubt is based upon the facts of each case brought before the Commission. Based upon prior decisions of the Commission, good faith doubt shall be deemed to exist in the following situation: ee ok 2. the closing or consummation date of the sale. . . has not passed, but one or more of the parties has expressed its intention not to close or consummate the transaction and the broker has not received conflicting or identical instructions from all of the parties concerning disbursement of the escrowed funds. 13. Section 475.25(1)(d)1., Fla. Stat. (1998), provides in part: (I]f the licensee, in good faith, entertains doubt as to what person is entitled to the accounting and delivery of the escrowed property... which property she or he still maintains in her or his escrow or trust account, the licensee shall promptly notify the commission of such doubts or conflicting demands and shall promptly: a. Request that the commission issue an escrow disbursement order determining who it entitled to the escrowed property; b. By interpleader or otherwise, seek adjudication of the matter by a court; or d. With the written consent of all parties, submit the matter to mediation. COUNT I Based upon the foregoing, Respondent is guilty of failure to provide written notification to the Commission within fifteen business days of the last demand or good faith doubt of the procedure instituted to resolve the escrow fund dispute and must institute one of the settlement procedures as set forth in § 475.25(1)\(d)1., Fla. Stat., within thirty days after having such doubt, all in violation of Fla, Admin. Code R. 61J2-10.032(1)(a) and, therefore, in violation of § 475.25(1)(e), Fla. Star. COUNT II Based upon the foregoing, Respondent is guilty of failure to maintain trust funds in the real estate brokerage escrow bank account or some other proper depository until disbursement thereof was properly authorized in violation of § 475.25 (1)(k), Fla. Stat. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475, Fla. Stat., depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative FDBPR vs Ian J. See § 475.25(1), Fla. Stat. and Rule 61J2-24.001, Fla. Admin. Code. The penalties which may be imposed for violation(s) of Chapter 455, Fla. Stat., depending upon the severity of the offense(s), include: revocation of the license, registration, or permit; suspension of the license, registration, or permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or permitee to complete and pass additional real estate education courses; publication; restriction of practice; injunctive or mandamus relief; imposition of a cease and desist order; or any combination of the foregoing which may apply.
