ADMINISTRATIVE COMPLAINT
. Petitioner, Charlie Crist, as Commissioner of Education, files this Administrative
Complaint against ANTHONY G. STEWART. The Petitioner seeks the appropriate disciplinary
Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of
Professional Conduct for the Education Profession in F lorida, said sanctions specifically set forth
in Sections 231.262(7) and 23 1.2615(1), Florida Statutes,
The Petitioner alleges:
JURISDICTION
1. The Respondent holds Florida Educator’s Certificate 454188, covering the area of
Psychology, which was valid through June 30, 2001,
2. At all times pertinent hereto, the Respondent was employed as a Social Science
Teacher at Detention Center School in the St. Lucie County School District.

3. On or about January 23, 1999, Respondent argued with another patron at a bar in
Indian River County, Florida. During the argument, Respondent shot the victim in the abdomen
Weapon. On or about August 13, 1999, Respondent was found guilty by a jury. On or about
October 7, 1999, the court adjudicated Respondent guilty, sentenced him to 4 years in state
prison (credit for 57 days served) with the requirement that he serve a minimum of 3 years as a
habitual violent felony offender, followed by 10 years probation, and that he pay $359.20 in fees
and costs. On or about J anuary 26, 2000, Respondent was terminated from his position,

RLALYLURY VIOLATIONS
COUNT 1: The allegations of misconduct set forth herein are in violation of Section
231.2615(1)(c), Florida Statutes, in that Respondent has been guilty of gross immorality or an act
involving moral turpitude.
COUNT 2: The allegations of misconduct set forth herein are in violation of Section
' 231.2615(1)(e), Florida Statutes, in that Respondent has been convicted of a misdemeanor,
felony, or other criminal charge, other than a minor traffic violation.
-COUNT 3: The allegations of misconduct set forth herein are in violation of Section
231.2615(1)(f), Florida Statutes, in that Respondent, upon investigation, has been found guilty of
personal conduct which seriously reduces his effectiveness as an employee of the school board.
COUNT 4: Section 231,.2615(2), Florida Statutes, provides that the plea of guilty in
any court or a decision of guilty by any court is prima facie proof of grounds for the revocation of
the certificate,
WHEREFORE, the Petitioner recommends that the Education Practices Commission
impose an appropriate penalty pursuant to the authority provided in Sections 231.262(7) and
which are attached hereto and made a part hereof by reference,
