BACKGROUND This is a proceeding to determine whether the City of J acksonville comprehensive plan amendment, adopted by Ordinance Nos. 2220-913-E, 2002-917-E, 2002-921-E, 2002-923-E, 2002-925-E, 2002-926-E, 2002-927-E, 2002-929-E, 2002-930-E, 2002-932-E, 2002-934-E, 2002-936-E, 2002-938-E, and 2002-939-E, on October 8, 2002, is “in compliance” with the FINAL ORDER NO. DCA 03-GM-054 Local Government Comprehensive Planning and Land Development Regulation Act, Ch. 163, Part II, Florida Statutes (the “Act”). The Department issued a Notice of Intent to find the amendment in compliance with the Act. The Petitioners filed a petition challenging the Department’s Notice of Intent, which alleged that the plan amendment is not “in compliance. The Petitioners subsequently filed a voluntary dismissal. The Administrative Law Judge issued an Order Closing File.
