Steven Looper Respondent ADMINISTRATIVE COMPLAINT RONALD BLOCKER, as Superintendent of Schools, for and on behalf of the School Board of Orange County, Florida, (hereinafter referred to as “Petitioner’), files this Administrative Complaint against Steven Looper (hereinafter referred to as “Respondent”). Petitioner seeks the severance of Respondent's professional services contract with Petitioner pursuant to Section 1012.33, Florida Statutes. The Petitioner alleges: 1. The Respondent, at all times material to this Complaint, was employed as a classroom teacher by the Petitioner, the School Board of Orange County, Florida. 2. The Respondent holds a professional services contract of employment with the School Board of Orange County, Florida. 3. That on or about March 13, 2003, the Respondent received a letter of reprimand and a letter of directives. Specifically, the Respondent had been reporting to work late and on the day of FCAT testing he reported late and did not call in to report his absence. The Respondent received a written reprimand for his lack of professionalism and failure to meet the expectations of management. A copy of the reprimand and directives are attached hereto and incorporated herein as attachments “A” and “B”. That on or about January 28, 2004, the Respondent sent an e-mail for personal gain to every employee on the Orange County Public School (OCPS) address list. The Respondent has his real estate license and his e-mail advertised his real estate services to staff. A copy of the e-mail is attached hereto and incorporated herein as attachment “C”. OCPS Information Technology staff closed the Respondent’s e-mail account as his e-mail reached the “I's” on the address list. The respondent's e-mail resulted in over 6.5 million messages being sent through the OCPS computer system. OCPS Information Technology required three (3) professional staff to work full time for three (3) days correcting the damage done to the computer system. That as a result of the Respondent's action, the OCPS e-mail system was inoperable for three (3) business days. The loss of productivity for all OCPS staff as a result is significant and impossible to calculate because it effects all OCPS departments and programs. That on or about February 4, 2004, the Respondent admitted to his supervisor and Employee Relations that he did send the e-mail. The Respondent also admitted that his supervisor, Dr. Janice Choice, Principal, Pineloch Elementary School, had reviewed Management Directive A-9, Employee Use of Technology, with all staff at the school. The Respondent acknowledged that he was aware that he could not use the OCPS computer system for personal use. A copy of Management Directive A-9 is attached hereto and incorporated herein as attachment “D”. Such actions by the Respondent are in violation of School Board Policies and constitute misconduct in office, willful neglect of duty, gross insubordination, conduct unbecoming a public employee, and a breach of Respondent's employment agreement with the School Board. Said violations are sufficient grounds to sever the professional services contract status of Respondent, Steven Looper, and to terminate his employment with the School! Board of Orange County, Florida. THEREFORE, the Superintendent of Schools for the School Board of Orange County, Florida, recommends that the Board sever its professional services contract relationship with the Respondent and terminate immediately the employment of Respondent, Steven Looper. On that date we met to discuss an allegation of misconduct on your pat. Specifically, alleged failure on your part to report to work on time. : = Having investigated this concer, it is my conclusion that you have arrived at work late on numerous occasions. On or about March 3, 2003, you failed to report to work and did not cali until 9:00 am. This incident was especially problematic because FCAT was being administered to your students on that date. The safety of students and meeting your professional responsibilities are critical to this administration and I expect you to take steps to address these issues. A directive will be issued to you in a separate correspondence that outlines the district's expectations regarding your conduct in the future. I am advising you that should there be another incident of a similar nature in the future discipline, up to and including dismissal, could be recommended. Additionally, the Network increases District communication, enhances productivity, and assists employees in upgrading their skills through greater exchange of information with their peers, parents, social service agencies, government agencies, and businesses. 1. District Responsibilities a. The Superintendent or Area Superintendents or designees will serve as the coordinator(s) to oversee the employee use of technology and will work with state and local agencies as necessary. b. The school principal will serve as the building-level coordinator for the use of technology, will approve building-level activities, ensure that teachers receive proper training, establish a system to ensure adequate supervision of students using technology, and be responsible for interpreting and implementing this Management Directive at the building level. c. The Senior Manager, Network, will establish a process for setting-up e-mail accounts, set quotas for disk usage on the system, establish.a retention schedule, maintain blocking software and establish a virus protection process for e-mail. 2. Technical Services Provided a. E-mail. E-mail allows employees to communicate with people throughout the world. Users can subscribe to mail lists to engage in group discussions related to educational subjects. b. World Wide Web. The Web provides access to a wide range of information in the form of text, graphics, photographs, video, and sound, throughout the world. The Web is a valuable research tool for employees. c. File Transfer Protocol (FTP). FTP allows users to download large files and computer software. ; d. Internet Relay Chat (IRC). IRC provides the capability of engaging in "real-time" discussions. The District will provide access to IRC only for specifically defined educational activities upon request to the Senior Manager, Network. e. Blocking software. The District provides software designed to block web access to certain sites. There is a wide range of material available on the Internet, some of which may not be appropriate for employees or students. It is not practically possible for the District staff to monitor and enforce a wide range of social values in the use of the 9SU135 - 03/01/99 lak ley é a. a. internet. Employees can request web sites to be blocked or unblocked via the District intranet. Push Technology: Automatic updating of software or information on District computers via background “push” Internet technology is prohibited unless it is used for specific educational purposes. While powerful and useful, this new technology could be used to spread viruses, and cause other operational problems such as system unavailability due to high use of bandwidth. . Employee Access to the Network All District employees have access to the Web through the District's networked computers. No agreement will be required. Individual E-mail Accounts for District Employees. District employees will be provided with an individual account via registration on the district Intranet. No agreement will be required. . Consultant Access. Consultants hired by the district for specific purposes may be granted an email account with the approval of a work location supervisor if there is a specific, District-related purpose requiring such access. The work location supervisor will be responsible for contacting the Senior Manager, Network for the establishment of the account and for the notification when the consultant leaves the District. Use of the system by a consultant must be specifically limited to the District-related purpose. . District employees shall not conduct a private enterprise, defined as offering or providing goods or services or purchasing goods or services for personal use on school time. District equipment or supplies, including technology, computers, and other equipment such as copiers and facsimile machines, may not be used for a private business or personal gain of the employee, or for the benefit of private, “for profit" or "not for profit" organizations, unless expressly authorized by the Superintendent or the Superintendent's designee. . The District authorizes employees to use District computer technology resources and databases for assigned responsibilities. These resources shall be used by employees to enhance job productivity as it relates to District business. These resources shall be used for District-related purposes and not for personal use or gain or for the benefit of private, “for profit" or “not for profit” organizations. District technology acquisition policies will be followed for the purchase of goods or services through the normal District purchasing procedures. . Network Security and Acceptable Use Employees shall not use the Web or FTP to search or download obscene or inappropriate material from the Internet. Employees using District computers who discover they have connected with a web site that contains sexually explicit, racist, violent, or other potentially offensive material must immediately disconnect from that site. The ability to connect with a specific web site does not in itself imply that permission is granted to visit that site. . Internet Resources and e-mail shall be used by employees to enhance job productivity as they relate to District business and shall not be used to send abusive, threatening or harassing messages. Employees shall refrain from communications where the meaning of the message, or its transmission or distribution, would be illegal, unethical or irresponsible. Examples include but are not limited to purloined passwords, stolen credit card numbers, and inappropriate written or graphic material (e.g., erotica). The decision to remove electronic mail privileges must be made by the employee’s supervisor or Employee Relations. When practical and feasible, individuals responsible for the message will be informed of the decision. . Employees will not use Internet Service Provider (ISP) accounts (except FIRN) via dial- up lines to access the Internet with District computers. Instead, all Internet activity must pass through the District firewall and proxy server so that access controls and related security mechanisms can be applied. . Any information generated through a computer, stored on hard disks, electronically mailed, or handled as e-mail is the same as any written document and is subject to all rules governing public information, and Chapter 119, Florida Statutes. . The willful and knowing unauthorized use alteration or destruction of information stored on District technology resources and databases is a computer-related crime punishable under Chapter 815, Florida Statutes. Employees/consultants will not attempt to gain unauthorized access to the Network or to any other computer system, or go beyond their authorized access. This includes attempting to log in through another person's account or access another person's files. Employees/consultants will not make deliberate attempts to disrupt the computer system performance or destroy data by spreading computer viruses or by any other means. ~All employees who have access to or may have access to personally identifiable student tecords shall adhere to all standards included i the Family Educational Rights and Privacy Act (FERPA), Protection of Pupil Privacy Acts, Sections 230.23 and 230.2316, Florida Statutes, and other applicable laws and regulations, as they relate to the release of student information. Employees shall not use access to student records information for personal gain. . If any unauthorized use of the Network has taken place, or is suspected of taking place, the work location technology coordinator must be notified immediately, Similarly, whenever passwords or dher system access control mechanisms are lost, stolen, or disclosed, or are suspected of being lost, stolen, or disclosed, the work location technology coordinator must be notified immediately, who will then take appropriate action including the notification of the Senior Manager, Network, if necessary. The specifics of security problems should not be discussed widely but should instead be shared on a need-to-know basis. . The Internet has been plagued with hoaxes alleging various security problems. Many of these hoaxes take the form of chain letters that request the receiving party send the message to other people. Employees in teceipt of information about system vulnerabilities should forward it to the Senior Manager, Network, who will then determine what if any action is appropriate. Employees must not personally redistribute system vulnerability information. Employees/consultants must not "test the doors" (probe) security mechanisms at either District or other internet sites unless they have first obtained written permission from the Senior Manager, Network. If employees probe security mechanisms, alarms will be triggered and resources will needlessly be spent tracking the activity. Likewise, the possession of tools for cracking information security (such as SATAN) is prohibited. 5. Copyright, Plagiarism and Media Literacy a. All software on computers must be licensed. Employees/consuttants are responsible for using software in compliance with this restriction, which pertains to those licensing agreements in accordance with Management Directive 15, Guidelines for Use of Copyrighted Material. Likewise, participation in pirate software bulletin boards, FTP sites and similar activities is prohibited. b. Because the extent of copyright protection of certain works found on the Internet is unclear, employees shall make a standard practice of requesting permission from the holder of the work if their use of the material has the potential of being considered an infringement in accordance with Management Directive 15. c. When using the Internet for class activities, teachers will select material that is appropriate in light of the age of the students and that is relevant to the course objectives. Teachers will preview the materials and sites they require or recommend that Students access to determine the appropriateness of the material contained on or accessed through the site. Teachers will provide guidelines and lists of resources to assist their students in channeling their research activities effectively and properly. Teachers will assist their students in developing the skills to ascertain the truthfulness of information, distinguish fact from opinion, and engage in discussions about controversial issues while demonstrating tolerance and respect for those who hold divergent views. 6. Due Process a. Any employee failing to comply with this Management Directive may be subject to disciplinary action as well as civil liability or criminal charges. The District will cooperate fully with local, state, or federal officials in any investigation concerning to or relating to any illegal activities conducted through Employee Relations. b. Employee violations of this Management Directive will be handled in accordance with Employee Relations. c. Any work location supervisor may terminate the account privileges of a guest account by providing notice to the user. Guest accounts not active for more than 30 days may be removed, along with the user's files without notice to the user. 7. Search and Seizure a. Employees have a limited privacy expectation in the contents of their personal files on the District Network. Employees should realize that their communications are not automatically protected from viewing by third parties. At any time and without prior notice, the District reserves the right to examine electronic mail messages, files on personal computers, web browser cache files, web browser bookmarks, and other information stored on or passing through District computers. b. Routine maintenance and monitoring of the Network may lead to discovery that a user has violated this Management Directive or the law. An individual search in collaboration with the employee's supervisor or Employee Relations will be conducted if there is reasonable suspicion that a user has violated the law or this Management Directive. c. District employees should be aware that their personal files might be discoverable under Florida Statues. 8. District Limitation of Liability a. The District makes no warranties of any kind, either express or implied, that the functions or the services provided by or through the District system will be error-free or without defect. The District will not be responsible for any damage users may suffer, including but not limited to, loss of data or interruptions of service. b. The District is not responsible for the accuracy or quality of the information obtained through or stored on the Network. c. The District will not be responsible for financial obligations arising through the unauthorized use of the Network.
