On April 12, 2004, the Agency referred the Request to the Division of Administrative Hearings for assignment to an Administrative Law Judge (“ALJ”). On August 27, 2004, the ALJ entered an Order Closing File, which relinquished jurisdiction of the matter back to the Agency. On April 2, 2008, the Agency entered an Order to Show Cause, asking the parties to show cause why a final order should not be entered in this matter since there had been no activity since August of 2004. On April 10, 2008, the Agency entered an Amended Order to Show Cause. None of the parties responded to the Amended Order to Show Cause. Based upon the foregoing, IT IS THEREFORE ORDERED AND ADJUDGED THAT: The Petitioner’s Request is dismissed with prejudice and the Agency’s March 10, 2004 Determination is hereby upheld.
