Respondent. / ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Addy Adler (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate sales associate, issued license number 375685 in accordance with Chapter 475 of the Florida Statutes. 3. The last license issued was as a sales associate with Home Town Realty of Broward, Inc., 55 Weston Road #103, Sunrise, Florida 33326. 4. Respondent is a licensed real estate sales associate in the state of Florida, and during FDBPR v. Addy Adler Case No. 2002008992 Administrative Complaint January and February 2002 she was employed with Wimbish-Riteway Realty, Inc. 5. On or about July 25, 1997, Respondent was buyer’s agent for Reverend Tommy Park as to property located at 8800 Southwest 8th Street, Plantation, Florida. (hereinafter referred to as property). 6. On or about July 25, 1997, Respondent was buyer’s agent for Reverend Tommy Park and property listing described the property to contain 3550 square feet. 7. On or about October 10, 2000, Respondent met with Reverend Tommy Park to list for sale the property located at 8800 Southwest 8th Street, Plantation, Florida. 8. On or about October 10, 2000, Respondent caused to be published in the Multiple Listing Service (MLS) that property located at 8800 Southwest 8th Street, Plantation, Florida had 4500 square feet “under air.” 9. On or about October 10, 2000, Respondent caused to be published in the MLS that property located at 8800 Southwest 8th Street, Plantation, Florida had golf course facilities, within the subdivision of Cocoplum, where property is located. A copy of listing information is attached hereto and incorporated herein as Exhibit 1. 10. On or about October 10, 2000, Respondent caused to be published in the MLS that property located at 8800 Southwest 8th Street, Plantation, Florida had access to 12 lighted tennis courts within the subdivision of Cocoplum, where property is located. 11. On or about October 10, 2000, Respondent caused to be published in MLS that property located at 8800 Southwest 8th Street, Plantation, Florida had access to a Clubhouse and a restaurant, within the subdivision of Cocoplum, where property is located 12. On or about October 10, 2000, Respondent had more than 23 years of experience in the FDBPR v. Addy Adler Case No. 2002008992 Administrative Complaint real estate business. 13. On or about October 10, 2000, Respondent had lived within the subdivision of Cocoplum for the past twenty years and was well informed as to the benefits provided to the residents of the community of Cocoplum. 14. On or about October 10, 2000, Respondent knew or should have known that residents of the community of Cocoplum had to pay a membership fee to join the private golf course available at Jacaranda. 15. On or about October 10, 2000, Respondent knew or should have known that real estate buyers have who live in a planned subdivision that have golf club(s) may enjoy a specific benefits such as golf course, golf available, golf equity, golf purchase. 16. On or about October 10, 2000, Respondent knew or should have known that residents of the subdivision of Cocoplum had no access to the tennis courts. 17. At all times material, Respondent knew or should have known that only members of the private golf course at Jacaranda had such privilege. 18. On February 15, 2001, in reliance of the representations made by Respondent, Complainant purchased the property for a price of $385,000.00. . COUNT I Based upon the foregoing, Respondent is guilty of misrepresentation, culpable negligence, or breach of trust in any business transaction in violation of Section 475.25(1)(b), Florida Statutes. COUNT I Based upon the foregoing, Respondent is guilty of having advertised property or services in a manner which is fraudulent, false, deceptive, or misleading in form or content in violation of Rule FDBPR v. Addy Adler Case No. 2002008992 Administrative Complaint 61J2-10.025 of the Florida Administrative Code and Section 475.25(1)(c), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant or permitee to complete and pass additional real estate education courses; publication; or any combination of the foregoing which may apply. See Section 475.25(1), Florida Statutes and Florida Administrative Code Rule 61J2-24.001. The penalties which may be imposed for violation(s) of Chapter 455 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license, registration, or permit; suspension of the license, registration, or permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense; imposition of investigative costs; issuance of a reprmand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or permitee to complete and pass additional real estate education courses; publication; restriction of practice; injunctive or mandamus relief; imposition of a cease and desist order; or any combination of the FDBPR v.
