FINAL ORDER
THIS CAUSE concerns a Petition for Formal Administrative Hearing that the Petitioner
filed on August 24, 2004.
On September 2, 2004, the Petition was forwarded to the Division of Administrative
Hearings (“DOAH”) by the Agency and assigned to an Administrative Law Judge (“ALJ”).
On September 2, 2004, the Intervenors filed Petitions to Intervene.
On October 11, 2004, the Petitioner filed a Notice of Voluntary Dismissal of its Petition
based on the withdrawal of its Certificate of Need Application no. 9752.

On October 12, 2004, the ALJ issued an Order Closing File based on the Petitioner’s
Notice of Voluntary Dismissal.
IT IS THEREFORE ORDERED AND ADJUDGED THAT:
The Petition for Formal Administrative Hearing is dismissed, Petitioner’s withdrawal of
its CON application no. 9752 is acknowledged, the Petitions to Intervene are dismissed as moot,
and this case is now closed.
