ADMINISTRATIVE COMPLAINT
DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION,
("Petitioner"), files this Administrative Complaint before the Board of Architecture and Interior
Design against COMMERCIAL FURNISHINGS and CRAIG JOHNSON, ("Respondents"), and
says:
I. Petitioner is the state agency charged with regulating the practice of architecture
and interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481,
Florida Statutes.
2. The Department of Business and Professional Regulation has jurisdiction over the
unlicensed practice of interior design pursuant to Section 455.228(1), and Section 48 1.223(1)(a),
Florida Statutes.
3. Respondents’ last known address is 2718 Centerville Road, Tallahassee, Florida
32308.
4. Respondent Craig Johnson is the president of Respondent Commercial
Furnishings.
5. Respondent Craig Johnson is not licensed to practice interior design in the State
of Florida.
6. Respondent Commercial Furnishings was previously a licensed interior design
firm holding license number IB !015 and Susette B. Crosby (“Crosby”), a licensed interior
designer, acted as the qualifier of the firm.
7. Respondent Commercial Furnishings license to practice interior design has been
in a delinquent status since February 28, 2003.
8. On or about July 31, 2001, Crosby notified the Florida Department of Business
and Professional Regulations that she withdrew as the qualifier for Respondent Commercial
Furnishings and leaving the firm without a licensed interior designer on staff.
9, In the 2003 edition of the Sprint Yellow Pages, which was issued in December
2002, Respondent Commercial Furnishings is listed under the heading for interior designers and
license number IB 0003554 is presented which is the individual interior design license of
Crosby.
10. ‘In February 2003, Respondent Commercial Furnishings provided quotes which
included space planning and design layouts for Home Instead Senior Care.
Li. On or about May 14, 2003, Respondent Commercial Furnishing provided a
proposal which included space plans and design layouts to Joan Stallings at the Florida State
University Center.
COUNT I
12. Petitioner hereby realleges and incorporates paragraphs one (1) through eleven
(11) as if fully set forth herein.
13. Section 481.223(1)(b), Florida Statutes, states that a person may not knowingly
“practice interior design unless the person is an interior designer or a registered interior
designer.”
14. Based upon the foregoing, the Respondents have violated Section 481.223(1)(b)
by practicing interior design when it was not the holder of a valid license by offering to provide
interior design services.
COUNT II
15. Petitioner hereby realleges and incorporates paragraphs one (1) through eleven
(11) as if fully set forth herein.
16. Section 481.223(1)(c), Florida Statutes, prohibits a person from using the title
interior designer or words to that effect unless the person is a registered interior designer.
17. Based upon the foregoing, the Respondents have violated Section 481.223(1)(c)
by holding himself as an interior designer when it was not the holder of a valid license.
COUNT III
18. Petitioner hereby realleges and incorporates paragraphs one (1) through eleven
(11) as if fully set forth herein.
19. Section 481.225(h), Florida Statutes, prohibits a person from practicing on a
revoked, suspended, inactive or delinquent license.
20. Based upon the foregoing, the Respondents have violated Section 481.225(h) by
offering interior design services while its license was in a delinquent status.
COUNT IV
21 Petitioner hereby realleges and incorporates paragraphs one (1) through eleven
(11) as if fully set forth herein.
22. Section 481.223(1)(d), Florida Statutes, states that a person may not knowingly
“present as his or her own the license of another.”
23. Based upon the foregoing, the Respondent has violated Section 481.223(1)(d),
Florida Statutes, by using the individual license number of Crosby and using such number after
she was no longer employed with the firm.
WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing an
administrative fine not to exceed $5,000 per count, assess costs associated with investigation and
prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes,
and/or any other relief that the Board is authorized to impose pursuant to Chapters 481 and 455,
Florida Statutes, and/or the rules promulgated thereunder.
