DOAH Case No. 05-0929 SCHOOL DISTRICT OF FCHR Order No. 06-021 LEON COUNTY, FLORIDA, Respondent. / FINAL ORDER DISMISSING PETITION FOR RELIEF FROM AN UNLAWFUL EMPLOYMENT PRACTICE This matter is before the Commission for consideration of the Order Closing File, -dated January 6, 2006, issued in the above- -styled matter by Administrative Law Judge Stephen B Dean. Findings of Fact and Conclusions of Law Judge Dean’s order reflects that the matter was before him on Petitioner’s “Motion to Dismiss the Hearing.” A review of that document reflects that Petitioner moved that the hearing scheduled for the case be dismissed, indicating that “Petitioner does not have a Counsel to represent her at the Hearing, and she is not prepared to represent herself.” Consequently, Judge Dean indicated, “The Motion to Dismiss is granted,” and ordered the file of the Division of Administrative Hearings closed. ; The Commission’s rules reflect that a Petition for Relief from an Unlawful Employment Practice “may be dismissed by the Petitioner without order of the administrative law judge, Panel of Commissioners or Commission (i) by serving, or during hearing by stating on the record, a notice of dismissal at any time before the issuance of the recommended order... The dismissal operates with prejudice with respect to Petitioner’s Chapter 760, FS, administrative remedies and. constitutes final agency action.” Fla, Admin. Code R. 60Y-5.008(7). ed We adopt the Administrative Law Judge’s findings and conclusions that Petitioner’ s Petition for Relief be dismissed. E Exceptions " Neither party filed exceptions to the Administrative Law Judge’s Order Closing File. FCHR Order No. 06-021 Page 2 Dismissal The Petition for Relief and Complaint of Discrimination are DISMISSED with prejudice. The parties have the right to seek judicial review of this Order. The Commission and the appropriate District Court of Appeal must receive notice of appeal within 30 days of the date this Order is filed with the Clerk of the Commission.
