Despain, Respondent. f ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, William 5. Despain. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training commission on September 5, 1995, and was issued Correctional Certificate Number 157626. 2(a) On or about June 14, 2004, the Respondent, William §. Despain, did then make a false statement during the employment application process concerning material matters to officials of the Department of Corrections, regarding academia claims, with the intent to mislead officials of the Department of Corrections. {b) On or about June 14, 2004, the Respondent, William S. Despain, did unlawfully falsely claim, either orally or in writing, to possess an academic Jun 3 2005 15:04 66/83/2885 15:18 858-416-7699 FDLE/ GENERAL COUNSEL PAGE &d degree, as defined in F.S. 435.11(1)(a), or the title associated with said degree. (c) On or about sanuaxy 31, 1955, the Respondent, William §. Despain, did unlawfully falsely claim, either orally or in writing, to possess an academic degree, as defined in F.S. 435.11(1) (a), or thea title associated with said degree. 3. The actions of the kespondent did violate the provisions of Section 817.567 or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or Rule 148-27.0011(4) (b) and/or (¢), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which remuire that a Correctional Officer in the State of Florida have good moral character. 4, This Administrative Complaint is ‘issued pursuant to Sections | 420.60, and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 118-27, 238-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, William §. Despain is guilty of violating Sections 943.1395(6) and/or (7), amd/for 943.13(7), Florida Statutes, and/or Rule 118-27.0011(4) (b>) and/or (¢), Florida Administrative Code, NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against William S.
