LEONI, Respondent. / ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Steven M. Leoni (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes, and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate broker, issued license number 571554 in accordance with Chapter 475 of the Florida Statutes. 3. The last license issued was as a broker at P O Box 2535, Tallahassee, Florida 323 16-2535. 4. On or about January 29, 2003, Respondent’s residential contractor’s license, license FDBPR vs Steven M. Leoni FDBPR Case N® 2003041889 Administrative Complaint number RR0066772, was revoked. A copy of the final order is attached hereto and incorporated herein as Exhibit 1. COUNT I Based upon the foregoing, Respondent is guilty of having had a registration suspended, revoked, or otherwise acted against in any jurisdiction in violation of Section 475.25(1){s), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as fina] agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant or permitee to complete and pass additional real estate education courses; publication; or any combination of the foregoing which may apply. See Section 475.25(1), Florida Statutes (2001) and Florida Administrative Code Rule 61J2-24.001. F.A.C., states that “material false statements or information submnitted by an applicant for certification or registration, or submitted for renewal of certification or registration, or submitted for any reissuance of certification or registration, shall constitute a violation of sec. 489.129(1)(a), and shall result in suspension or revocation of the certificate or registration”. | 9. Based on the foregoing, the Respondent violated Section 489.129(1)(a) by obtaining a certificate, registration, or certificate of authority by fraud or maisrepresentation. CONCLUSION OF LAW: a.) b) Steven Leoni, Villetta Homes, violated 1994 Standard Building Code Section 2405.2.1.3, which states: Glazing in an individual fixed or operable panel adjacent a door where the nearest vertical edge is within a 24 inch (610 mm) radius of the door ina closed position and whose bottom edge is less than 60 inches (1524 mm) above the floor or walking surface. Steven Leoni, Villetta Homes, violated Leon County Code 5-478 (c) (10) (a), which states: The contractors’ licensing and examination board shail have the authority to discipline, by placing on probation, or reprimanding the contractor, revoking, suspending, or denying the issuance or renewal of the contractor's license or registration, requiring financial restitution to a consumer, imposing an administrative fine not to exceed $1,500.00 per violation, requiring additional hours of continuing education over and above the state requirements for license renewal, or assessing costs associated with investigation and prosecution, locally licensed or registered contractors, if the contractor has been found guilty, by the contractor’s licensing board, the state construction industry licensing board, or a court of competent jurisdiction, of any of the following actions: (10) Committing mismanagement or misconduct in the practice of contracting that causes financial harm to a customer. Financial mismanagement or misconduct occurs when: (a) Valid liens have been recorded against the property of acontractor’s customer for supplies or services ordered by the contractor for the customer’s job; the ; contractor has received funds from the customer to pay for the supplies or services; and the contractor has not had the liens removed from the property, by payment or by bond, within 75 das after the date of such liens. d. Steven Leoni, Villetta Homes, violated Leon County Code 5-489 (c) (14), which states: The contractors’ licensing and examination board shall have the authority to discipline, by placing on probation, or reprimanding the contractor, revoking, suspending, or denying the issuance or renewal of the contractor's license or registration, requiring financial restitution to a consumer, imposing as administrative fine not to exceed $1,500.00 per violation, requiring additional hours of continuing education over and above the state requirements for license renewal, or assessing costs associated with investigation and prosecution, locally licensed or registered contractors, if the contractor has been found guilty, by the REPORT NISTRATIVE: COMPLAINT: «= oor [ EXHIBIT. & PAGER Be | : oe ORDER: Steven Leoni PAGE FOUR contractors’ licensing poard, the state construction industry licensing poard, or 4 court of competent jurisdiction, of any of the following actions: (14) Signing 4 statement with respect to 4 project oF contract falsely indicating that the work is bonded; falsely indicating that payment has been made for all subcontracted work, labor, and materials which results in 4 financial loss to the owner, puschaser, or contractor, falsely indicating that workers’ compensation and public liability jnsurance are provided. The above stated violations are grounds for disciplinary action under Section 439.113, Florida Statutes. In accordance with Florida Statutes, Chapter 489.131(7)(c) and (d), the disciplined contractor, the complainant, or the Department of Business and Professional Regulation may challenge the local jurisdiction enforcement body’s recommended penalty for Board action to the State Construction Industry Licensing Board. A challenge shall be filed within sixty (60) days of the issuance of the recommended penalty to the State Construction Industry Licensing Board in Jacksonville, Florida. If challenged, there is a presumptive finding of probable cause and the case may proceed before the State Board without the need for a probable cause hearing. Failure of the disciplined contractor, the complainant, or the Departraent of Business and | : Professional Regulation to challenge the local jurisdiction’ s recommended penalty within the time period set forth in this subsection shall constitute a ‘waiver of the right to a hearing ‘before. _> the State Construction Industry Licensing Board. A waiver of the right to a hearing before the State Board shall be deemed an admission of the violation, and the penaity recommended shall become a final order according to procedures developed by the State Board rule without further State Board action.
