Case No. 2005041689 4S / ADMINISTRATIVE COMPLAINT The DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, DIVISION OF HOTELS AND RESTAURANTS, ("Petitioner’), files this Administrative Complaint against RAMADA INN, (“Respondent'), and says: 1. Petitioner is the state agency charged with regulating the operation of public lodging establishments and public food service establishments, pursuant to Section 20.165 and Chapter 509, Florida Statutes. 2. Respondent is, and has been at all times material hereto, licensed by or subject to the jurisdiction of the Division of Hotels and Restaurants. The respondent's business address of record is 4220 S HARBOR CITY BLVD, MELBOURNE, FLORIDA 329011326. The mailing address of record is RAMADA INN, at 420 S HARBOR CITY BLVD, MELBOURNE, FLORIDA 329011326. 3. Inspection of this establishment conducted pursuant to Sec. 509.032, Florida Statutes, revealed violations of the provisions of Chapter 509, Florida Statutes, and / or the rules promulgated thereto governing operation of the establishment. The violation(s) found and applicable law are described in Exhibit “A,” attached hereto and incorporated herein by reference. Inspection documents are attached as Exhibit"B", incorporated herein by reference. WHEREFORE, Petitioner respectfully requests entry of an. Order imposing one or more of the following penalties: administrative fine not to exceed $1,000 per offense; mandatory attendance at Respondent's expense at an educational program sponsored by the Department's Hospitality Education Program, suspension, revocation, or refusal of a license issued pursuant to this Chapter, and/or any other relief authorized by Chapter 509, Florida Statutes, or the rules promulgated thereto. We were in Melbroume for the Viet Nam Veterans Reunion and had made reservations In advance. The motel room #234 smelled heavily of mold and mildew, as did the halls. There was mildew on the walls and in the Ice bucket The fiberglass tub in the bathroom was not properly chalked and had what seemed to be a large amount of water under it Standing In the tub was llke standing on a air matress in a poot of water. You could easily loose your balance. This could be extremely dangerous. A few of the ather guests that we spoke ta0 reported the same problems. Most motels In town were filled to capacity due to the vaterans reunion, so are option to find another room was not good. | understand the devastation that occured with the 2004 hurricanes, because | tao lost my place to Hurricane Charlie. | believe that motels or any other places of business should not be allowed to be open and running until they make repairs that would ensure pubiic safety. A complaint was made at the fromt desk at checkout. | also feel that men and women who fought for this country should be treated with more respect. Thank You.
