In a Final Audit Report (F.A.R.) dated December 21, 2005, Judith Sweetbaum, M.D. (Respondent) was informed that the State of Florida, Agency for Health Care Administration (Agency) was seeking to recoup Medicaid overpayments in the amount of $32,431.14. The F.A.R. contained full disclosure and notice regarding Respondent’s administrative hearing and due process rights, Respondent requested a formal administrative hearing to dispute the facts contained in the letter. The matter was referred to the Division of Administrative Hearings and was assigned case number 06-0376MPI. The Respondent sent the Agency a Notice of Withdrawal of Request for Hearing dated April 7, 2006 confirming that Respondent is withdrawing her petition for a formal administrative hearing and the Administrative Law Judge issued an Order Closing File dated April 10, 2006, which are incorporated by reference. FINDINGS OF FACT The Respondent, JUDITH SWEETBAUM, M_LD., has paid the Agency the amount of $32,431.14 plus a $3,000.00 fine to the Agency’s Finance and Accounting Department on January 9, 2006. Therefore, no other action affecting the Respondent under the above-styled case number is pending. Based on the foregoing, the request for a hearing is dismissed and the file is CLOSED.
