ARCHITECTS AND ENGINEERS, P.A., b O 637 Respondents. / ADMINISTRATIVE COMPLAINT DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board of Architecture and Interior Design against RABBANI ABU MUHAMMAD AND RABBANI MUHAMMAD ASSOCIATES ARCHITECTS AND ENGINEERS, P.A., ("Respondents"), and says: 1. Petitioner is the state agency charged with regulating the practice of architecture and interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481, Florida Statutes. 2 Respondents’ last known address is 905 E. Park Avenue, Tallahassee, Florida 32301. 3. Respondent is, and has been at all times material hereto, a licensed architect in the State of Florida, having been issued license number AR 14163. 4, On or about June 14, 2000, Respondents entered into a contract with Monammed Abass io perform architectural services for commercial property. 5, Respondent Rabbani Muhammad Associates Architects and Engineers, P.A. does not have a certificate of authorization to offer or provide architectural services in the State of Florida. 6. The contract specifically provides that Respondents will prepare construction documents and obtain a building permit. 7. Respondents have received $6,000.00 under the contract; however over five years afer the contract was signed, the Respondents have not provided the construction documents and a building permit has not been issued. COUNT I 8. Petitioner hereby realleges and incorporates paragraphs one (1) through seven (7) as if fully set forth herein. 9. Section 481.225(1)(g), Florida Statutes, states in pertinent part that committing any act of fraud, deceit, negligence, in competency, or misconduct in the practice of architecture constitutes grounds for disciplinary action. 10, Based upon the foregoing, Respondent Rabbani Abu Muhammed has violated Section 481.225(1)(g), Florida Statutes by committing misconduct in the practice of architecture. COUNT It 11, Petitioner hereby realleges and incorporates paragraphs one (1) through seven (7) as if fully set forth herein, 12. Section 481.225(1)(j), Florida Statutes, states in pertinent part that disciplinary action may be taken for failing to perform any statutory or legal obligation placed upon a registered architect. NS) 13. Based upon the foregoing, Respondent Rabbani Abu Muhammed has violated Section 481.225(1)(), Florida Statutes by failing io perform his legal obligation under the contract, COUNT II 14, Petitioner hereby realleges and incorporates paragraphs one (1) through seven (7) as if fully set forth herein. 15, Section 481.219(2), Florida Statutes, requires a certificate of authorization to practice architectural services through a corporation, partnership, or under a fictitious name. 16. Based upon the foregoing, Respondent Rabbani Muhammad Associates Architects and Engineers, P.A., , has violated Section 481 .219(2), Florida Statutes, by practicing architecture without a certificate of authorization. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing an administrative fine not to exceed $5,000 per count, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 481 and 455, Florida Statutes, and/or the rules promulgated thereunder.
