Peays, Respondent. : - : / AD E COMPLAINT The Criminal Justice Standards atid Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Kenneth F. Peays, The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on August 27, 1997, and was issued Correctional Certificate Number 174054 and on August 26,1998, was issued Correctional Probation Certificate Number 181955. 2. On or between December 1, 2000 and May 16, 2002, the Respondent, Kenneth F. Peays, did unlawfully introduce into or upon the grounds of the Bradenton Probation Restitution : Center, a state correctional institution, or take or attempt to take, or send or attempt to send therefrom, a sword cane, a pen containing a knife, and a pen containing a pepper spray device, an article or thing declared to be contraband, except through regular channels as authorized by the officer in charge of the institution. . 3. The actions of the Respondent did violate the provisions of Section or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or Rule 11B-27.0011(4), Aug 4 2006 17:07 ga/ad/ 2086 17:82 8584187691 FDLE O08 PAGE 85/86 Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require: that a Correctional and Correctional Probation Officer in the State of Florida have good moral character, . 4, This Administrative Complaint is issued pursuant to Sections 120. 60, and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be | conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Kenneth F. Peays is guilty of violating Sections 943.1395(6) and/or (7), and/or 943.13(7), Florida Statutes; and/or Rule 11B-27,001 1(4), Florida Administrative Code. ; — ~ NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Kenneth F.
